    I have received this from POPLA

    "The Lead Adjudicator is appointed by London Councils. As previously published, the Lead Adjudicator is a barrister with thirty years of experience who has also sat as an adjudicator on several tribunals over the past 18 years. The Lead Adjudicator is responsible for the recruitment and training of Assessors. The Lead Adjudicator is satisfied that those so appointed, who are all graduates, have the necessary skills and ability to carry out the role of Assessor."

    I agree with the suggestion that a plausible reason for the delay is that the Lead Adjudicator is trying to reconcile his great legal and procedural knowledge with the BPA's apparent "If you think you have grounds for appeal you are wrong" attitude to this NON-STATUTORY 'appeals' process.

    I also hope that they are clued up about contract law and the way it differers from the laws that govern "proper" parking tickets issued by councils.

    I also suspect tha POPLA have been appalled by what they have seen so far - what fun to be a fly on the wall with some PPC cases being considered!

    Adjudicator (ringing up or emailing ScammersRUs for their side of the story):
    - 'so ScammersRUs, tell me what evidence you have that a contravention occurred and the rules & regulations you are relying on for rejecting an appeal from a Blue Badge holder in a private disabled bay, when after merely a cursory glance at the BPA Code of Practice it seems to me that you MUST NOT issue a PCN in such a situation?'

    Scammer:
    - We are a proffesional firm and we even put some signs up and did you notice are 'PCNs' almost look like real ones?

    And...and anyway are template letters are only set up to say no so we couldn't of cancelled it, we don't know how.

    And...and...the BPA said we could join they're club and...and we've got there logo on are shiny new website an' all.

    And...and we want the money to help to fund the company owner's next horse/yacht/sports car. Wasn't it bad enough when they took our clamps away, how do expect us to make a living, we'll have to go back on the rob if you take are money away.'

    Adjudicator:
    Fake PCN cancelled. NEXT! Oh...same again...
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • it is quite amusing to some degree. I have two further appeals at Premier Park on the same defence as the POPLA appeal so it makes it clear I really am not to be messed with (thanks BASFORLAD for the wording) and I wonder if they are holding off responding until such as the outcome of my POPLA appeal........

    I was going to go down the POPLA route on both of them, but I wanted to see what Premier Park would do when hit with the facts in the face straight up.
