Newbury v Davis is a defence against the owner being convicted for aiding and abetting no insurance when they've lent the vehicle to a friend and it being lent "conditional" on the friend having appropriate insurance.
OP........you have no defence if the police get to know about it and decide to prosecute, the case given above means that, (assuming the circumstances are the same) you friend does have a defence and I'd get a solicitor to run that defence for him if it ever gets to court.
As for the damage to the other car, hopefully the TP insurer will write to you in the first instance which will give you the opportunity to settle without getting the van's insurer involved.0 -

Would it be possible or wise to contact the 3rd parties Insurer before they get to my pals insurers? How can I find out who they are without asking the 3rd party who now just hangs up as soon as I introduce myself?0 -

I havent said anything other than "id be happy to pay for the repair" I then follwed it with "and give you a tank of fuel for your trouble." If someone had damaged my car and offered to do that id be overjoyed but shes taken exception to it. I dont get it.0
