I may be wrong but I thought if he "was" taking you to court you could have the hearing where you want.
I'd have it further away ie he's in Oxford you're in West Yorkshire go further North for about a couple of hours. Just a thought to wind him up.0 -
If he had studied civil law, which he clearly hasn't, he would be aware that the case (not that it has a cat in hells chance of getting any where near court) would be heard in your nearest court not his.
He sounds like a typical armchair law 'expert' who knows chuff all save a few key words he's read on the Internet.
I'd get in touch with eBay by telephone and demand they take action, ban him and remove the feedback he left you.

Just report him to Ebay for being threatening and abusive, refuse any further cancellations, and do NOT communicate with him in any way!

No chance of a summons, and even if there was, you should be able to have the hearing relocated to a local court of your choosing, as you consumated the purchase in your armchair.illegitimi non carborundum0

A seller threatened to take me to Court for libel as she considered that my negative feedback damaged her reputation and led to a loss of sales.
She asked for my solicitors details, so I just called her bluff and gave her the details. I never heard from her again.0 -
LOL...what a tool....anyway don't cancel the transaction and let the seller take you to court for the fees...then you choose the court a local one to you no need for you to travel. You'll win the case just by turning up and not saying very much at all.:footie:

I am a Ebay seller with 100% positive feedback. This !!!!!! seller needs banning. Sellers like this give the rest of us a bad name
have you filed an action through ebay's resolution centre. Have a look at Ebay Selling Practice Policy especially the section on product availability. If the emails are abusive and threatening you could always go to the police.
