parking charge free car park

Hello there again everyone, just thought I would update you on the ongoing parking ticket fiasco. Got the letter to owner letter yesterday(Friday 25 Jan 2013) It looks to be the same as the one posted on the letter chain thread. I didn't expect any letter judging by some of the comments regarding being banned from dvla. Any hows, I have had panic attacks and all sorts regarding this, they want £100. Not quite sure what to do now, whether to ignore the notice or to appeal it. I need some good solid advice regarding this as I was in the car park for the right reasons, but couldn't find a space because of all the people who use the free car park and walk to the hospital where they have to pay to park. Please help.I'm not crazy, it's just that your reality is different to mine0

Please don't let this worry you, their demands are against the Equality Act 2010, you should follow the post by coupon #19 in this thread and complain to the hospital. If you don't they won't know that they are in breach of said act.
In regards to the threats from excel they are just junk mail, they will not take you to court, they are designed to scare and harass you. Just look at the letter chains to see the next one that will come. Many many people have been in exactly your position myself included and have just ignored them like a Nigerian prince asking for your bank details. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. Another quick question, I know from various reports that excel were banned from obtaining dvla info, if the offence took place on 20/12/12 letter sent out on 23/01/13 when would they be able to get dvla info?
ThanxI'm not crazy, it's just that your reality is different to mine0 -
The ban ended on 17/01. Because you got a ticket on the car, they first wait for 28 days to see if you cough up or appeal directly. After the 28 days, only then do they go to the DVLA for your details. Unfortunately for you 20/12/12 + 28 days is exactly 17/01/13, so they were therefore able to legitimately get your details after the ban was over.thebrickdepot wrote: »Another quick question, I know from various reports that excel were banned from obtaining dvla info, if the offence took place on 20/12/12 letter sent out on 23/01/13 when would they be able to get dvla info?
Not that it matters too much. You know just to ignore all letters.0 -
This info is a little comforting to say the least. After reading quite a number of different related items regarding this issue, I feel that I have to go and examine the signage at the hospital. Hopefully it may give some insight if they are recovering parking losses(free car park = no financial losses) or a parking contravention(outside of lines) which mine was. Will have to show the wife some of these other related articles as she is the only level headed one in the family literally.I'm not crazy, it's just that your reality is different to mine0

They are not recovering financial losses, I mean does it cost £100 to park there normally ? Okay you may have parked over a white line, have they incurred a loss of £100 by you doing so ? This is a civil case from a private parking company, this is just a money making scam by the parking company.
What you have is an illegal penalty for breaching an alleged contract, they won't listen to reason, they make up the rules at spur of the moment, if its not on their sign they will make another reason to ticket you.
All they are interested in is parting you with money, this is purely a cash cow for them, when they look at vehicles they don't see the make and model just pound signs. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

You don't need more advice.
Same advice as I already gave you in my post a couple above yours. I did tell you that you'd get the letters and how to complain, and who to.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi there everyone, just thought I would let everyone know that since January, I have received no more correspondence from excel parking so I am letting this rest as a win for me. I would like to thank everyone for their helpful advice and support regarding this issue. This I think is an example of how these forums are an advantage to the average Joe who would have paid the said fine. Than again everyone.:j:rotfl::T:)I'm not crazy, it's just that your reality is different to mine0

I am pleased to hear that you are over your worry. I had the same problem over two years ago - read the helpful advice on this forum, ignored the fine (I actually never heard another word, no letters, nothing), and to this day haven't heard anything at all from this bunch. I wouldn't have paid it anyway but I remember being quite distressed at the time so I can understand how you were feeling.
Take care!0
