its allright moaning saying do what the job centre tells you to do, but when that is an unlawful instruction, that makes a mockery out of judicial function through political dogma

    Unlawful? Please elaborate.

the whole process of signing up for the universal job match site through threats of sanction are not MANDATORY

telling people they have to apply for 30 jobs a day or be sanctioned is unlawful

the data protection act issues are that you cannot be forced to give access to your electronic communications with threat of a sanction unless statutory requirement dictates it.

this is contained not only under the data protection act 1998, but also the recent directive from Europe on accepting tracking cookies and artical 8 on the European convention of human rights

the statutory legislation the government has to abide by is Regulation 18 of The Jobseeker’s Allowance Regulations 1996

there are no amendments to this legislation about it being compulsory to sign up for the universal job site or applying for up to thirty jobs a day.

    in fact it states

Steps to be taken by persons actively seeking employment 18.—(1) For the purposes of section 7(1) (actively seeking employment) a person shall be expected to have to take more than one step on one occasion in any week unless taking one step on one occasion is all that it is reasonable for that person to do in that week.

be it you agree with it or not, that is the statutory authority we have to abide by, even Herr smith cant twist that

    Hmmm...

I'd be interested to hear where you think a Job Seekers Agreement (and the wording of it) fits into this process.

the job seekers agreement is just that an agreement

it holds no statutory authority in law

an agreement is a two way process

you do not have to agree to the terms,

The Jobseeker’s Allowance Regulations 1996 is the statutory instrament, the job seekers agreement is not statutory and cannot be used to override statutory requirement.
be it the job seekers allowance regulations or the data protection act

    Hmmm...

Strange......because I understood that if the JSAG is not agreed to and signed by both parties, it gets sent off to the Decision section to be reviewed? Unless/until the matter is resolved, I understood you cannot receive any benefit at all, because no JSAG = no claim? Suppose your adviser makes reference to using UJ on your JSAG?

But you obviously know more about this than I do :)

It will be interesting to see how the new guidance for JCP staff is worded.
