And?
They can't repeat the advert and must ensure future adverts say prices may rise with RPI.
The only difference is they have to tell people process could go up, no doubt in the small print we don't read, won't stop prices rising mid contract in the future.0 -
does any mobile advert state they are fixed or wont go up? nopeDon't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0

I'm sure they'll find a way to pay their way out of this....then pass the costs onto the customer *cough* corruption! *cough*0

There's nothing to find their way out of. The ASA deals with adverts nothing more.
The ASA ruling just says they have to mention it in the small print in future, not that they must not put prices up mid contract.0 -
So those who purchased contracts after the leaflet was produced can use it to prosecute breach of contract ?0

Probably not. The leaflet probably says T&C apply and they are on the contract you sign.
MSE's post does say...
However ASA did add that the leaflet hadn't made any claims that monthly tariff prices were fixed and that if a consumer had taken out a contract with Three, it did say in the terms and conditions that prices could rise in line with inflation.0 -

There is no law that says Ts and Cs trump evidence of breach of CPRs, and there is now no logical reason to suggest 3 mobile are off the hook - to the contrary, 3 mobile are very much now on this particular hook.0 -

Go for it....0
