i know its not concellation now to you OP, but may i sugget fir future refrence that you get yourself a in car camera to record your outings one in the front one facing the rear? i know its an expense you could do without but perhaps if anything like this in the future does happen (tooch wood not) then you have evidence to provide for a conviction.0

There is now an App for Android phones that makes them into an in-car camera0

Police phoned me today to inform me that they have been unable to find any cctv, and that they are going to close the case.
Spoke to solicitor who said thae wife will not be able to claim against me as it would mean that i would be admitting fault, he said we could claim from mib but thay would take 30% of anything we got.
Car will not be ready untill at least 10th Jan, Need to pay £350.00 excess when i pick my car up, and i will also lose 2 years no claims when i renew in November...it makes me so mad....
without either an identified car or an identified driver the MIB won't deal with the case and in any event, if your own insurer has paid to fix your car those costs/excess/ncb can't be later recovered from the mib even if the car/driver are identified0 -
Strange, i need to get this sorted as i was told by our solicitor that we could claim, but they would take in the region of 25% of any award made to us.without either an identified car or an identified driver the MIB won't deal with the case and in any event, if your own insurer has paid to fix your car those costs/excess/ncb can't be later recovered from the mib even if the car/driver are identified0 -
as above, you can only go against the MIB if either the car or the driver is identified. Even if this does happen then the MIB will only cover your uninsured losses, this will include injuries & excess but, as you have already claimed on your own insurance, you won't be able to get those costs or your NCB back from the MIB.
If car or driver is identified (so a claim is possible) I'd seriously think about changing solicitors as I'd have thought you should be able to find someone to do it at no cost to you, in fact some firms will even give you a referral fee for letting them take your case0 -
This isn't strictly true. You can put in a claim to the MIB in cases of personal injury when there is an untraced driver. It's called the untraced driver's agreement. Also, afaik OP the MIB provide free legal cover as well.as above, you can only go against the MIB if either the car or the driver is identified. Even if this does happen then the MIB will only cover your uninsured losses, this will include injuries & excess but, as you have already claimed on your own insurance, you won't be able to get those costs or your NCB back from the MIB.
