  • OP. Try the MIB. I thought it was for the sort of thing that has happened to you.

The Motor Insurers' Bureau (MIB) has been operating since 1946 and is funded by the UK's motor insurers and -- by extension -- insured, law-abiding motorists.
If you're involved in accident with an uninsured vehicle and forced to claim on your own insurance, then the MIB will compensate your insurer for the costs of your claim. Once this compensation has been received, your insurer should reinstate your no-claims discount and cancel any corresponding premium increase.

To do this the op needs the vehicle details and/or the drivers.

Really? I thought the Untraced Drivers Agreement (2003) changed that. But maybe i am reading it wrong. Maybe they still need to find the car.

The problem is there is no evidence they are drunk.

Why do you automatically assume they are drunk rather than disqualified, no licence, insurance or wanted?
When they are caught it will become clear if they were disqualifies, had no licence, had no insurance or were wanted at the time of the accident.
Whereas if they were drunk there would be nothing to say they were drunk the next day when finally caught.

To me, failing to stop implies failing to give a sample. I agree the law should be changed so that it bears the same punishment. Why give an incentive for someone over the limit to not stop?

It doesn't imply anything in law tho.

Been to see a solicitor he has said the wife can't claim from me as this would mean that it was my fault, he is on to the case ..as 2 buses were in front of me ( cameras ) als it was on a busy junction with camera , he said he will go to the police and city watch for cctv footage...if we get a car we can go on ...but with no car they will take 25% of anything we get from the mib.....keeping my fingers crossed..the police seem to take an age to get going re cctv.

with no car you may not have a case with the mib and to keep the 25% go to them direct.

Police phoned me today to inform me that they have been unable to find any cctv, and that they are going to close the case.
Spoke to solicitor who said thae wife will not be able to claim against me as it would mean that i would be admitting fault, he said we could claim from mib but thay would take 30% of anything we got.
Car will not be ready untill at least 10th Jan, Need to pay £350.00 excess when i pick my car up, and i will also lose 2 years no claims when i renew in November...it makes me so mad....
