Advice Please CSA

Hi, just looking for some advice.UPDATE AT END OF THREAD ***

My CM case was closed in July due to it being unsafe. I had to fill out another MEF which they received by beginning of August. I chased a few times and finally in October i got a call from someone who had been given the case. She said she would phone me on 12 November and let me know where we were.

Needless to say she did not phone. I have called 3 times now and she has not been there each time, and the people i spoke to put a note on the screen for a call back.

I phoned once more on Friday, one again my caseworker was not there but i was told that it was with the Financial Department and they had said they would be finished on the 19th.

Does this mean we may be getting closer to an assessment? I have no idea what the FD do.

Once gain a note was put on to give me a call back but i doubt if i will get one.

    I'm confused by the post, not sure if you are the NRP or PWC, not that it matters in a sense.
    With everything running smooth, it can take several weeks months to got from MEF to CS contributions.
    Not sure what you mean by unsafe MEF form though :o

    Sorry if i have confused you, i confuse myself too!

    I am the PWC.

    The CSA closed the case as it was unsafe, no one can explain why but basically they closed it and then asked me to make a new claim.

    They have told me this week that the case is with Financial Dept and that they say they will be finished with it on the 19th.

    I am just wondering where in the process we may be if the case is with them , if that makes any sense?

    I always thought that if you closed a case and reopened within 13 weeks, it reactivated the old case, and for it to be closed there could be NO arrears at all otherwise it could not even be closed...

    Sounds very strange to me...!

    I have tried to find out why, got my files but all the info about it was blacked out.

    From the hints that they gave without actually telling me, it seems they made an error in the assessment due to info from HMRC.

    Seems like someone made a BIG mistake.

    Anyway, the new case is with the Financial Payments Team (?)

    and they will be finished with it on Wednesday whatever that means.:rotfl:

    Involve your MP as a matter of Urgency, with all teh info you have, they cannot by law close a case with debt, and opening a new case would as i said if done within 13 weeks activate the old case...

    If there was an error in Assessment due to the wrong info from HMRC then it can be corrected easily enough, it does NOT make it unsafe, and why would it be with the Financial Payments team now..? Have you had an assessment completed...? I just don't get it...

    Kick up and phone your MP urgently...!

    Lol it is crazy isn't it? No one i have spoken to has heard of closing a case because it was unsafe.But it is there in my files surrounded by blacked out paragraphs. I assume the new case is with the FP team as we are near to a new assessment, but who knows?

    I will contact my MP tomorrow but he is pretty useless.

  • Update today.... i have received letter stating the assessment is £67 per week from 23 July 2012.:T

    He was paying by DEO previously, do they usually keep to that or give him a chance to pay properly?

    He has been non compliant for many years.

    Having the letter is one thing, but as you added, he has been non compliant, then prepare for a roller coaster ride, usually the NRPs that loath contributing will put in as many delays as possible (although they can't get away with it forever) :o
    Wish you well with a succesive claim, you should get another later to confirm when the contributions will start.

    My son is 14 and i only began to get payments in April 2011, so yes i am used to the game playing.

    I am hoping they go for a DEO again but not sure if they can go to one straight away

    I would still be inclined to contact your MP pronto ( as Kevin advises) because you have been denied maintenance for 6 months due to their error. I believe you should receive compensation for this and the quickest way is via your MP.

    Do quote Financial Redress for Maladminstration - see sticky post top of this forum.

    Have the CSA admitted this error - you say case is with Financial Payments Team?

    yes they can implement a DEO.It will normally take a good month at least before the new DEO kicks into place.

    Was he compliant for 6 months when the previous DEO was in place? If so you might be able to apply for an advance payment, although there is strict criteria.

    Again everything through your MP. Phone them up and ask their assistant to phone the Parliamentary hotline giving a brief summary of your case.
