I would still be inclined to contact your MP pronto ( as Kevin advises) because you have been denied maintenance for 6 months due to their error. I believe you should receive compensation for this and the quickest way is via your MP.

Have the CSA admitted this error - you say case is with Financial Payments Team?
yes they can implement a DEO.It will normally take a good month at least before the new DEO kicks into place.
Was he compliant for 6 months when the previous DEO was in place? If so you might be able to apply for an advance payment, although there is strict criteria.
Again everything through your MP. Phone them up and ask their assistant to phone the Parliamentary hotline giving a brief summary of your case.

yes they have admitted that it was their error, i have my files as well and can see odd snippets bout them taking advice on the case and that it must be closed.(in between the blacked out paragraphs)
I received a call from Bolton i think Feb 2011 asking if i still wanted to receive Cm ( having had nothing for years) then i received a payment into my bank out of the blue with no letters or info bout it. payments continued until June 29. then i received a letter telling me the case was closed as it was UNSAFE and that i needed to re apply.
I will contact my Mp as you both advised, he is quite hard to get hold of so will e mail as well.
Oh and yes i was advised on Friday that the case was with the Financial Payments team and they would be finished with it on the 19th so i was surprised to get a letter today.

Your ex will get an assessment letter today too, and they'll be contacting him to ask him to set up payments immediately. If he doesn't respond in a week then they'll impose a DEO. There might be a slight delay to do with christmas breaks and bank holidays with the CSA and also with his employer. Hopefully your first payment should arrive in Jan/Feb.0

This is after years and years of botch ups.
The MP's assistants do the hard work, Star.They are your best friends. Doubtful whether you will get a surgery appointment now, so like I said give them a ring and ask the assistant to phone the hotline.Book an appointment for the new year.0 -

Oh dear, he will not be a happy bunny, he has been trying so hard to get a private arrangement which i have refused due to his non compliance.
It is so annoying, all PWC want is the Child support the children deserve.

You know coming to a private arrangement might not be a bad thing. However you would have to come to some arrangement re:arrears.
I would be asking for a complete account breakdown from the CSA.

I had two CSA cases. Both nightmares.
Re: 1st case. He is a self employed barrister. For some reason ( well I do know but not saying open forum) we came to a private arrangement where he agreed to pay the CSA figure until our child was 18 and the CB ceased. I got this in writing signed by both of us and informed the CSA.
He paid it ...for a while via Standing Order...bliss... but then it stopped. I was led the runaround...SO stopped ( I know whynew GF on the scene)payments in dribs & drabs, excuse after excuse, invited round to his house because he had some cash, but none available when I went....this is also in front of our son...you get the picture?
Soooo what I did was involve the Small Claims Court....breach of contract. I let this go on for well over a year as, after all,he might pay £15 per week or month, and he had supposedly money problems.
When my son reached 18 he still owed a few hundred quid. Excuses again. So in the end I got the baliffs round. Paid them £100 and 4 weeks later ( they fell for his excuses the first time) I received the FULL amount plus their fee. He paid by credit card. This is strange as he told me he was so broke he only had a simple bank account, no chequebook etc.
He is such a liar. That £100 baliffs fee could have been used towards our son as he is now at Uni. And he also promised to help our son out. This has not happened. But I continue to help him out.
So a private agreement might be worth considering. Tell your ex it's always best to keep the CSA out of your lives. Then the games can stop. If he ceases to pay he knows you can get the baliffs on him...and it's much quicker.0 -
Well he promised to pay money into my account for sons Xmas Presents and surprise surprise he didn't.
He has not done so for the last 5 years so i am not surprised, but as he promised i thought i would wait and see.
This is the man pushing for a private agreement!
Well i think he can forget that for sure.

I finally received an assessment in December, disputed by the Ex, revised assessment received beginning of February, he duly paid on the 28th Feb , seems the payment is in the system but not released yet.
However the problem i am having is with the case they closed due to being unsafe, i have a letter stating they will not ask me to pay back the CM received due to their mistake.
Falkirk spoke to me Friday saying arrears due to me from July to February which amounts to approx £1700, i will not receive as they will be keeping that as i was overpaid in the case they closed if that makes sense. Surely if they have stated i would not be required to repay as it was agency error then that is not right?
They also said they would ask for a consolatory payment for me but not to expect more than £25.
Are they correct here or am i? If anyone has an idea i would really appreciate it. Thanks0 -

Back to your MP I'm afraid from the info you have given here. Your case needs to be in the hands of the Parliamentary complaints dept or whatever the title of it is now.
For the record I received £250 consolatory payment, overpayments written off etc. But this was in a long line of historic CSA coc*k ups.
