Personally I would try Ofcom on this to see what they have to say. It falls under their remit on companies charging via mobile
Thanks, I will try Ofcom. I have tried the Telecoms Ombudsman, who can't help and Phone Pay Plus who are interested in the case.0 -
So you got your son a contract in your name, He ran up a bill and now you want either the game operator or mobile phone operator to loose out because of YOUR negligence.
No, they didn't. Try reading the thread next time. Try reading even the first post. Then you'd be less likely to look a fool.
Not surprisingly though you were thanked by MamaMoo for your pointless contribution.0 -
Whilst it can be reversed, why should they have to? As far as they are concerned, they verified that the mobile number that was input belonged to the user, OP's son, by texting the phone and requiring a reply.
With regards to making it too easy etc, it's no easier, really, than stealing a debit card and topping your phone up by however much. In this situation, also, the OP could not claim the money back via her bank as she would be deemed to be negligent with her card.
Of course we can say the OP was negligent with we phone, there was no passcode lock etc on there. This is why children should not be allowed access to a post-pay phone. A 13 year old child, if requiring access to a mobile phone, should have his own, or a family one which is prepay only. In this case, OP's son had unsupervised access to a phone, which he used to make unauthorised payments. This is not Jagex's issue, it's the OP's son.
I find it ridiculous that OP is trying to claw back money from an innocent 3rd party. I think she and her son should shoulder the costs as it was down to his thievery and her negligent behaviour that they are in this position. Why should Jagex be down £150.
Also, as a parent, should the OP not be monitoring her son's Internet usage and looking at the T&C's if websites he's using so she can check them?!
I have three sons and I have to say that I have never once been called negligent in either their care, upbringing or welfare. I am very proud of my boys and have never had cause to suffocate them through monitoring their every move. They have very full and active lives through school, sport and clubs not leaving them a whole lot of time for internet use. What time they do spend on the internet is limited and I have never ever have cause to look over their shoulders all the time. In response to your claim that I am negligent, I would say that perhaps I was naive. I thought I had enough content bar on the phone and did not know this could be bypassed. I didn't even know he could buy gaming credits let alone use a mobile to pay for it. I don't have time to check the t&c's on websites but have never expected I would have to. This has been an eye opener to me and a hard lesson to learn and certainly one my son won't forget for a long time. However, I still maintain that this should not be able to happen to anyone else and I will be doing my utmost to resolve it and bring it to light so other unsuspecting parents don't fall into the same trap!0 -

You seem more bothered with pointing out to the OP how much better you are than them, how this would have never happened to you, etc, etc. Which is all great until you make a mistake.
Thank you! I do seem to be getting an ear bashing from Mama Moo on this. Does she have a vested interest in Jagex?0 -

Thanks I have looked at section 5. I need to read it a couple more times as my son is not under 13.......he is 13. I need to understand what the following part means exactly.
"If you are under 18, by using our website you are representing (i.e. making a promise) that you have consent from your parents/guardian to use Jagex Products in accordance with our terms and conditions and privacy policy. We may Stop any account if we are not satisfied that such consent has been given."
My son did not have permission0 -

*snigger*
I must work for them as I think you're wrong? What a classic retort.
Also, please note, I'm not saying you are a bad parent by saying you are negligent, I am saying you were negligent with your protection of your phone, and perhaps lazy/negligent/naïve with the controls you could have put in place to prevent this.
You say about your 3 sons never having done anything wrong before, but the point is, now they have, and it was easily preventable.
Much as you want to raise awareness of how easy it is for your son to do this, I am merely pointing out ways that things like this can be prevented, and ways you can protect yourself in the future.0 -

My bad, I forgot we can only tell people what they want to hear and not the truth.0 -
Well I think the OP should pursue it by whatever means are available. I had a similar experience a couple of years ago... my 3 teenagers all have contract phones, in my name. During the summer holidays two of them ran up horrendous bills, just through normal use, texting, calling friends. I had no recourse so had to pay the bills. What I did immediately following was to limit their contracts with the provider (three) so that they couldn't go a penny over their contract allowance, and to ensure that the contracts had sufficient minutes/texts included so that this wouldn't cause a problem. In addition they had extra chores to pay back the extra spend. I'm sure the OP has learnt a lesson and has taken the necessary steps to prevent a recurrence.
Thanks for sharing your experience and I'm sure your son won't be doing it again in a hurry.
PS - my eldest son had a bit of a runescape addiction at one time; he grew out of it!0 -

The OP should pay it, She didn't have control of her son and he run up the charges, I don't think the operator or game operator should take the hit. The OP should, She could sell his iPod etc to get the money.
Oh you are now officially on ignore troll.0
