The phone is in perfect condition not a single scratch or bump on it, it have been kept in a gel case with a screen protector on from the moment it was opened! it has never been in contact with water! or ever been dropped.
i AM very OCD with new phones and treat them like new born babies

Ok. So what is your back up plan if they say "No"? Do a bit of reading/ printing out of your consumer rights from either OFT, SOGA, CAB or even Which? Make sure you understand the extracts and have a copy for them.
But they DO have the right to send the handset away for diagnosis as, even though I fully believe what you say, it is possible that any 3 week old handset being returned could have been damaged by the customer and the shop has the right to have that checked out first. So you will need to hand over your handset to be sent away.
Ask for a loan handset in the meantime and then go to CAB in the intervening period to see if you have the right to demand a refund. Personally, and from experience of this forum over years, I don't think you can, but more than happy to be proved wrong.0 -
Yeah Sorry mis read the post. From what I have read carphone warehouse are not disputing the item was faulty they simply do not want to refund.
To be honest unless there are obvious signs of the phone being dropped or clear signs of water damage then the fault is going to be defect so what's the point of sending it away.
Most retailers offer a straight refund within 28 days probably because they understand the law?

It's probably a problem with the industry in general and their lack of understanding of the law or complete ignorance of it.
I have had to return a few faulty items from time to time in first 28 days and never really tended to have a problem. I tend to buy my items though from companies who tend to believe in good customer service.
At the same time even pc world swapped a faulty iPad a couple of years ago about 2-3 weeks after it was bought as a present and curry's a wii 8 months after it was bought.
Neither item had to sent off.
Sometimes you have to remind retailers of the law but they normally accept their obligations once they realise you have vague idea of what you are talking about.0 -
on a slightly different note, I had a new/faulty laptop from CPW, went to my local CPW, who refused to my request for a replacement, this was depsite the mention of Sale of goods act etc
anyway I emailed the CEO of Carphone Warehouse, always seems to work wonders when you go straight to the top
next day I got a very apolagetic phone call from the CEO office, oh and I also got a brand new replacement laptop0
