Comet TV, 4 months old developed fault where do I stand?

Nope, a manufacturers warranty (if there is one) can be contracted out of by the retailer and indeed most manufactuers warrantys can have getout clauses for the manufacturer.
You have a minimum of 6 months through the retailer (where the retailer has to prove it was something you did that caused it to fail) over that up to a period of 6 years (of discovery of the fault) you can raise a claim but you may have to prove the fault.
Most retailers do a year where it's assumed to be a inheriant fault and either repair it themselves or utilise the manufacturer/repair agents, the reason for the year instead of the 6 months is it's become a retailer standard, so everyone does it and everyone has the same playing field.0 -
I rather suspect he wants the assurance that buyers 'normally' get:
i.e. if the seller has gone bust then he can return it to the manufacturer.
Frankly I think JVC are playing silly beggers here -who gives a toss whether it's rebadged by vestel as a JVC -JVC were presumably paid something for the use of their name at the very least.
If a car has 'VW' on it I care not if Skoda or Seat made it, I have a warranty claim with VW not with the others.
Wrong, you have a claim with the RETAILER.
No rights with JVC as per SOGA0 -
Thanks CHC, very interesting!
Matty: I know it is normally the retailers responsibility however since I have seen notices in the press etc from Comet stating faulty goods now go back to the manufacturer in the first instance I thought this was now the case for the OP.Unless specifically stated all posts by me are my own considered opinion.

I think that there are probably two lines to follow here.
As a consumer when I buy something from a shop I expect SOGA to apply. In this case Comet (or more accurately the administrators) are saying that is not the case and they will not repair or replace the faulty TV.
Since I have no recourse to Comet my next option would be the manufacturers. The TV is branded JVC so I expect that JVC will honour the 1 year's manufacturers waranty that came with the TV. I don't expect to be told that it's really not a JVC tv and that I'd have to go to the "real" manufacturer.
Has anyone had any response from JVC in respect of them honouring the manufacturer's gaurantee?0 -
I have to say I would be VERY peed off if my new TV was the same (LG) as I've also taken up RicherSounds on their very good 5 year insurance policy.
Frankly I think if a TV is not made by the makers whose badge is on it, it should make this very clear indeed before anyone buys it.Unless specifically stated all posts by me are my own considered opinion.

Will try to issue a chargeback, but as I paid with debit card it looks like there is a 120 day limit and it is just passed that.
Correct 120 days from date of debit.
To do a chargeback. It would have to be faulty from when you got it. Chargebacks do not cover faults that develop after purchase.
Sad that the manafacture won't pick this up. Would be great customer service on their part and may make people buy their products in the future....
Would you after this experiance....Never ASSUME anything its makes a>>> A55 of U & ME <<<0 -
I guess thats true, fair point.
Although saying that Apple do great after sales care: I had my macbooks case replaced 3 years after purchase FOC.Unless specifically stated all posts by me are my own considered opinion.

Although legally JVC can wash their hands of the faulty TV, it's certainly worth pestering them a bit.
Nothing ventured nothing gained and all that.0 -
do all companies do this? get a cheap tv and allow others to stick their name on it?
I'll be avoiding JVC completely after this0
