That's really positive I think?! I too sent off my rejection letter to the FOS about 2 weeks ago so hopefully will get something through soon also. Will post any update when I get it...

After hearing nothing from the FOS I e-mailed them with the following -

    Dear Mr Ablett,

We are as yet to receive any response from the FOS regarding our complaint.

We understand that the same, standard letter has been sent out already to others who have made a similar complaint to ours, but as yet, we have received nothing.

Please can you confirm for us if a response has in fact been sent, and if so could it be re-sent as it would appear to have been mislaid through the postal system.

We obviously, like numerous others, want the opportunity to challenge the decision that has been made on this matter.

Also the document will be passed on to Watchdog as they continue to piece this all together for us members of the public affected by NRAMs huge error.

    Regards

Two days ago I received the same holding letter from the FOS but today I received this e-mail -
Re the attached, I am the adjudicator to whom your case has been allocated. The decision in your case has not yet been issued but I will be doing so in the next twenty four hours.

As you are no doubt aware, these cases have been considered by senior colleagues in this service, however, if you want to talk to me about the decision once you have received it, then please do not hesitate to contact me on the number below.

    Yours sincerely
    David Rogers
    Adjudicator, Financial Ombudsman Service
    Tel.02079640512
    Fax. 02079640513

I have followed up with this response -
    Mr Rogers,

thank you for taking the time to respond to us.

Although you state "The decision in your case has not yet been issued but I will be doing so in the next twenty four hours." it is clear by the following comment "if you want to talk to me about the decision once you have received it, then please do not hesitate to contact me on the number below" that the decision actually has already been made and like many others, we will be receiving the same, standard letter indicating that our complaint has in fact not been treated individually on it's own merits but has been grouped together, resulting in the same outcome.

Rest assured, my husband and I will be in further contact, as will the many other people affected by this. This is not going to be put to rest until NRAM take responsibility for their Fraudulent errors.

Thank you again though, for this e-mail, as it re-enforces how the FOS is actually dealing with all of these complaints. It would actually make more sense for you to post on your website that if you are complaining about NRAM and their misleading loan agreements don't bother - we work for the government, who own NRAM, and we therefore are going to do anything possible to help them wriggle out of this. It would save these "senior colleagues" so much time!

    Regards
I will let you know when we receive the same letter as some of you already have.

Nice work!!! I am now past 2 weeks since I wrote back to the FOS to challenge their decision.

However the first letter I received from the FOS saying I/we had no complaint was at 7pm on the Friday before the last bank holiday......
  • Nice response ajm!
I have put my letter of complaint into NRAm and had the same standard response, I wondered if there is a general letter template anyone has used for the complaint to FOS? Obviously I will alter it to reflect my circumstances but if we are all at least singing from the same sheet as so to speak it may help, the more people complain and the more new complaints they get, they will have to do something!

As hard as it is, try not to lose your cool.
Paragraphs like this will do nothing but ensure your correspondance ends up at teh bottom of the pile, nearest the bin.

If the FOS are obviously not taking this seriously then why not issue a group complaint to the OFT too. Both bodies work closely together, it would be interesting to see what their response would be. They obviously know about it but are keeping conveniently quiet so perhaps it's time to put it under their noses so they have to comment and give a view point about all of this.

You may be right, but it still gave me a good chuckle - nicely put ajm!

Re my own complaint (which was returned to me unanswered in March, before the FOS decided to look at the issue) - they have now asked me to resubmit, so I will amend to take into account the points in their response to others.

Be sure to let them know that of the thousands of nram customers complaining to fos they have upheld 0% of them. So clearly they are not based on their own merits as they claim....

Have received the same response letter from the FOS and have just sent off our response - still keeping our fingers crossed.

Oh how frustrating is all this. I have now moved so have had to now move to my current MP who is a minister. I think when I tell my story and will tell something like this, sold me a product saying "don't worry its all protected" Have now been found as not complying with CCA and now saying sorry, got ya, you are not protected and never have been and see what happens. Hopefully he might be as daft to say its disgusting, only then worth dropping in the NRAM involvement. I am so disappointed by the FOS, how dare they state that you would have made the same decision. Since when has any part of contract law been argued as "we believe" so tough luck.
