Mobile Phone Contract - Provider Not Honouring Agreed Price

Hi folks,

First time post so please be gently ;-)

The situation I have is this. I upgraded my mobile phone / contract online with Three. The deal offered to me online was an iPhone4s on the Ultimate Internet 500 plan for £18 a month. This deal seemed very good to me so I took it. I have email confirmation from Three regarding the deal. The phone was duly delivered and activated by Three. Now when I get my first bill Three want to charge me £34 a month for the contract. Obviously I am challenging this but I wanted to know where I stand. If Three refuse to honour the original price for which I have documentation can I hold them in breach of contract? The phone has been delivered and activated by Three.

    Are you sure it isn't a cash-back offer?

    No definitely not, was done via the Three website. The don't do cash back offers.

    I find it a little difficult to believe that 3 entered into a mobile contract for a free iPhone4S for £18 a month. The going rate is minimum £30.

    What exactly does the email say?

    Daft question, but are they saying that it's £34 a month or just that your first bill is for £34. If it's the latter then it could just be that your bill covers more than one month (your first bill often does).

    I've recently subscribed to a deal with Three that was advertised as £29 a month. Looking at the bill it actually shows as £33 a month but then I get £4 a month recurring discounts, so the actual amount is only £29 a month.

    Just found an iPhone 4 deal on Three advertised as this...

    Total Price £34 per month
    Base tariff: £18 per month
    Phone: £199 upfront + £16 per month

    I wonder if it's this that you've signed up for? The extra £16 a month is paying for the phone maybe?

    It then shows the Item listed as IPhone4s Ultimate Internet Plan 24 month contract, Monthly Charge £18.00, One Off Cost £0.00, International Roaming Opt-out £0.00, Delivery Charge £4.99

    Total Added to your next bill: £22.99

    We have just spent an hour on the phone to Three and as expected they are refusing to honour this now, even though we have confirmation email.

    The upgrade was done by signing in to my Three account and going through their online upgrade procedure

    Things is, if its a mistake then fine they can have the phone back but release me from the contract. At the moment they are refusing to honour or release me from the contract.

    It doesn't seem to say that a phone is included.

    Can you copy and paste the entire email? It sounds like the extract you posted might just refer to the call-time rather than the phone.
