This person now seems to be selling an identical item to the one that was 'lost'.

Yip he is, really p*sses me off. That's about 5 of these cards he's sold since February. Not to mention the two top end intel processors and the few handfuls of RAM. I really really wanted that graphics card, shame I couldn't claim him for lost gaming hours as well lol

    Hi Everyone,

Thought I'd bring this post back from the dead.

After filling in a small claims form online the seller eventually gave up, closed his ebay account and sent me a full refund. I also discovered he had tried to rip off another ebay seller but he was a little smarter this time - he sent an envelope that the buyer had to sign for making it difficult for them to prove that they never received their item.

At the end of the day I'm still down £30 because of the court fees which I believe don't get refunded. I should have proceeded with court action and made him pay big time. What I will do though is send a nice e-mail telling him what a scumbag he is instead!

Big thanks for all the help!

Well done on getting the refund

Don't send him a nasty email as he might then get nasty

The envelope he sent to the other buyer would need to weigh the same weight as the one with the item in or it can be proved that the item wasn't actually sent.

How can people like him sleep at night?
