Seller won't refund, options?

The seller has left the buyer a negative and called him a "lier". Even though the buyer hasnt left feedback yet. A little unusual.
The buyer should leave a neg and let people know of the problems IMO.
As Soo says, others may be in the same position.Be nice0 -
I hadn't noticed that smashed...
The OP must be commended then for trying to sort this out rather than run to a neg, but now I would feel a neg totally justified . Also the poor OP has now got a feedback rating too low to be a serious seller, which if I was him would make me ultra determined to do what I could to get my money back off the seller.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. Id say small claims court and at least you have the email saying he doesnt agree he should be the one to lose out. Isnt it in ebay's policy that it is the sellers responsibility to ensure the item arrives?Saving needed to emigrate to Oz*September 2015*
£11,860.00 needed = £1,106 in savings

An ebay claim can be done but will only recover up to £120 of which £15 will be kept as a fee by ebay. However, there is a difference of opinion on here as to whether a bank transfer is covered by an ebay claim as ebay help appears to say two different things. I have always assume though that a bank transfer is not covered as ebay do warn against using them.
Paypal do consider it to be the sellers responsibility though, which is why it is ually better to use paypal where there is any concern over a seller, but backed by a credit card as paypal is not 100% reliable of course.

Please dont forget to file a non performing seller dispute.
In this situation as well, i hate to say it, as it is against ebay morals, but £200 is alot of cash. I would create a few new accounts, and REALLY mess this guy around. Ruin his auctions, make him lose his powerseller status etc. I am an honest person, and usually would resort to this. But what ebayer sells something worth £200 recorded delivery?0 -
Looking at his feedback, there has been 7 ratings withdrawn - whats the betting they were all negs??:j30/7/10:j

Agreed! Looks like there have been a few "missing items" or unresolved problems with this seller. I'd suggest that slam2k5 file with eBay for a refund and contact their local Police station to file a complaint. I'd contact as many of this person's other victims as possible so you can add their names and details to your complaint. This way they can coordinate with the Police CID Officer in the seller's locale investigating your case. Ask them to also file complaints so the Police can quickly see that it isn't an isolated case, but rather a large-scale premeditated fraud.

Thanks for the replies guys,
I was in contact with the seller for months, I have his name and bank account details so I don't think anything has been hijacked. His e-mail address is a blueyonder account as well.
The reason why he won't refund me is and I quote "why should I be down £235 and a graphics card", the way he see it Royal Mail has lost the parcel so he shouldn't refund me. He didn't take out insurance when posting, the item was sent First Class Recorded but the tracking number he gave me brings up no information on Royal Mail's website.
The guys an idiot sending a reply like that. The seller obviously doesnt care that you are £235 down! I also can't believe he sent the item via 1st class recorded delivery! Normally when I sell an item and the value is over £40 I always send special delivery to cover me. I agree with the rest of people on here, try and get as much evidence as possible and talk to your local police officer. I would be doing exactly the same thing as £235 is quite a bit of money!"He's a maniac, maniac that's for sure,
He will kill your cat and nail him to the door"

Yip, so looks like I'm taking the boy to court.
I'm not sure how to proceed from here, has anyone got any advice on how to take someone to the small claims court? I live in Scotland so I'm a little unsure if it works differently up here.0 -
Report him to the Tax Man for Tax evasion whilst you're at it. He's down as a private seller when it's obvious he'd be classed as a business. I am willing to bet money that he's not declaring his Ebay income to HMRC, even though he's a Power Seller. In a rut? Can't get out? Don't know why?
