    Greetings.

Once again thanks to everyone who has posted here. I have not had a chance to do anything for a week or so, but had planned to write another letter based on the one from hoohoo. However.....before I could a letter from Claire Robinson at Debt Recovery Plus hit the mat.

Should I now just ignore and let them carry on digging themselves deeper into their hole, or try another appeal requesting a POPLA Code, and if so who too?

    Regards

That's nice of Claire, she turns into James at Zenith Collections next - the same signature ;)

I would still go for the scammers and ignore DR+ if I was you
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

  • Hi everyone.

I received one of these stupid parking tickets in Earlham House Shopping Centre.
I was only there for about 20 mins and when I returned a ticket was slapped onto my car window!!! According to them I was not parked wholly in a parking bay. NPE had placed signs (which I have taken pictures of) making it look said it was ok to park there. if they don't want anyone to park there then they should double yellow it or put up NO PARKING signs.

Is it wise to appeal or just to leave it and ignore it? I am a law abiding citizen and this is the first 'ticket' whether it be speeding or parking.

I'm now stressing about it as there's no way I can afford the fine

    Please help!!!!

You really need to start your own thread about this to avoid being missed altogether or having your situation confused with others.

Only start your new thread when you get the Notice to Keeper in the post, unless this is a company/lease car in which case you have to appeal sooner. As explained here (different circumstances, different firm, same advice):

    https://forums.moneysavingexpert.com/discussion/4613139

In the meantime whilst waiting, read threads on the forum itself, about appealing and POPLA as it relates to ANY PPC (not just NPE). Any thread about any private parking company (PPC) is useful for you to read on the first few pages of the forum (except Council ticket cases).

See my signature, the forum is ONE CLICK away.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you Stroma for your reply.

I will follow your advice. The letter in hoohoo's post seems to get to the point so will send that unless you or anyone else thinks it is a bad idea.

What is happening here is that currently the DVLA are taking so long to reply to the operators that the operator cannot always get in touch with the registered keeper in time to Serve the Notice to Keeper.

Well, thats the DVLA's fault, but luckily for you it means you are off the hook. Perhaps the parking company will sue the DVLA for their lost money :-)

Here is what I think you should do.

    1) Write again to the parking company

    ''Dear Sir,

Further to my appeal, POFA 2012 requires that the Notice to Keeper be served between 28 and 56 days of the parking incident.

You are knowingly in breach of this requirement. Please inform me of the date you applied to the DVLA for my data, and the date you received their reply so that I might decide what further action to take against you.

I will not be entering into further correspondence with you, but reserve the right to complain to the BPA and the DVLA.

I require you to uphold my appeal, or decline the appeal and issue me with a POPLA code within 35 days of my initial appeal.''

    2) If you want to land these guys in it, and possibly get them banned from DVLA access, complain anyway to the BPA and DVLA. Come back here if you want to do that.

    Looks good to go! :T

    RESULT!!!

    Dear ** *********

Firstly, I must apologise for the incorrect information being sent.

When dealing with this originally, our team mistook the PCN to be issued remotely, not to the vehicle, which would have different rules.
You are right regarding the timings and therefore we have cancelled the charge.

    regards

    NPE Ltd

Coupon-mad, hoohoo, stroma, nigelbb my thanks to you and everyone else who helped.

As the story appears complete is there a thread to post all the correspondence (or the complete thread) for others to see and realize you can win.

    Once again thank you.

Well done, what a result indeed! :T

There is this thread which can be used for Council or Private ticket successes:

    https://forums.moneysavingexpert.com/discussion/1268723

...for posting a brief summary for posterity and a link to your thread here.

It's an amusing repsonse from NPE. If this was a 'remotely issued' camera fake PCN then they would've had just 14 days to write to you (an even stricter timescale!). :D

    Hello

I have been reading all the posts about the above company and others similar and have found it informative, so thank you.

I received a PCN from NPE late last year and was advised by family and friends to ignore, as it was a scam! Which I did.

Then once they handed "my debt" over to Debt Recovery Plus (DR+)who started writing to me, I got worried. I wrote back contesting the PCN but was too late for POPLA, DR+ have rejected my claim and are still threatening court action.

Should I reply, pay or are there any other ways I can contest this PCN?
