On 20th November I made a purchase through www.childrensbooksworld.co.uk using my Halifax Visa Debit card

I got a confirmation email and then a few days later I went to check the order status and sent a message through the site asking when it would be despatched. I heard nothing so I returned to the site to find it was down. I have since replied to the email address the confirmation email came from with no joy so I'd like to get the money back.

I have never had to do anything like this before. Is it just a case of going into the bank and asking them to reverse the payment? Do I need anything else? There was no contact phone number of the site (email contact page only), so I have no phone contact details of the site owner, just an address from a whois google search.

Call your bank (or go in), advise them that you want to raise a chargeback (some call it Visa dispute). Talk them though what's happened, and they will submit a chargeback request for you.

DO NOT CANCEL THE ORDER WITH THE RETAILER....

You will need to wait 15 days from the date of debit before they can start the dispute.
You have already tried to resolve. So no issues there.
It should be able to be done over the phone with no paperwork from you.
Never ASSUME anything its makes a

At no time have you actually confirmed you have charged! An important point, as the Bank often take the details and don't confirm there has been a debit. The lack of response from te retailer in so short a timeframe is not a legitimate reason for a chargeback, and neither is a change of mind.

Yes, you would be covered under the DSR, but that is for the merchant to refund. Only when this fails should a CB be authorised!

eh? My bank has been debited with the charged amount. the website is down and has been for 3 weeks, i have had no email stating the item has be sent, there has been no answer to the 20 emails I have sent in the last month. So I have asked for my money back in the only way I can. I have no interest in dealing with such shoddy businesses.
  • hi everyone

    I need some advice.

Me and the Mrs wanted an inbult wardrobe custom made built and I found a tradesman on gumtree. I called him up and explained what I wanted, he got back to me with a quote with an invoice and his bank details. He said a deposit of £300 for the total amount is needed. I did a lot of research and background checks for this company and it seems legit, they have a website, facebook and twitter page.

Anyway, I agreed to send the payment via an online wire transfer to his account (I don't know what I was thinking, I built a good working trust with the guy and we wanted the wardrobe built and fitted). The trademans said he will call me 7 days later to confirm that it's been made and to arrange fitting.

Seven working days later I tried calling back via landline and mobile and email, but no reply. Eventually a few days later he apoligised saying that something has happened with his business which involved HMRC hence why the delayed response. He asked me when you want the wardrobe fitting, I replied tomorrow. He said a fitter will come out to install it. The next day came and the fitter never turned up, I called the tradesman, but his mobile phone says "sorry this number isn't recognised" and landline just keeps riniging. So, the next day me and the Mrs decided to pay a visit to find his unit, but we couldn't locate the unit at the address specificed on his website.

I payed by my Ultimate reward visa debit card via online transfer, I have the date of the transfer, invoice, bank details, the business address, phone number, email address and even have the first call recorded when I spoke to him.

I just went to Halifax bank and explained can I get a chargeback for this payment. They said chargeback can only happen on credit cards.

Is this true? Can I not get a reverse payment chargeback?

    Thanks for any advice.

No, not true - Section 75 rights are associated specifically with credit cards but chargeback covers debit card purchases too, assuming you satisfy the relevant conditions (e.g. claim within 120 days, etc). See http://www.moneysavingexpert.com/shopping/visa-mastercard-chargeback for a briefing on this....

P.S. You mention both payment by debit card and online wire transfer to his account, chargeback will cover the former but not the latter....

I only did a payment of £300 online transfer from my ultimate reward account (the card says visa debit) to the tradesman's bank account.

Will this still be a problem?
