Premier Park - advice please

Hi I live above a (edited to preserve id), which has recently begun to use Premier Park to regulate their car park.

For information, I have my own parking space elsewhere.

Last week my son visited and parked in one of the (spaces) (unbeknown to me), it was 7.30 in the morning and he was here for an hour or so, before the shop even opened. He received a PCN for £100 or £60 if paid within 14 days. We are still within the 14 day period.

I went into the shop and spoke to the manager who was surprised that they had started issuing tickets since they were supposed to make themselves known to her and give her permits for her staff cars and take registration numbers of cars with permission to park. They still have not done this.

My question is this. The reason given on his ticket is 'no permit' however if they have not as yet issued permits to anyone, is this legal? Should I appeal? Or simply writeto them refusing to pay on the grounds that no one has a permit yet which makes the grounds for the fine invalid.

I have read through the threads but am a little confused as to whether I should make a formal appeal including my personal details or withhold my personal details and just site my argument and state I am refusing to pay.

Any advice would be appreciated.

    The best advice for your son providing he is the RK of the vehicle is to ignore the parking company and their agents. For further reassurance view these videos by the BBC and Watchdog

    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    he isn't the registered keeper, I am. We just never got round to changing it. I know the general concensus of opinion seems to be to 'ignore' but I wasn't sure if that still applied to a company that was a member of the BPA...

    Yes it applies to the bpa members, more specifically their AOS members, without being part of that parking companies will not be able to contact you unless you do so first.

    The BPA is just a cosy members club. Members have no special legal standing or powers. Just ignore them.

    Debt Recovery Plus Ltd demanding payment of £150, one dated 20/2/13 and just this week, though undated, a Notice of Intended Litigation...any advice appreciated. Should I still ignore?

    Yes just ignore them, you'll get a letter from Zenith next who are actually debt recovery plus pretending to be someone else, just look at the bottom of the letter when you get it, it will say that they are trading as zenith
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    A couple of things

    1 see if you can get a pass for your visitors from the pet shop
    2 If they are charging for parking then their business rate will rise and their customer numbers will fall.
    3 is it their land?

    The way that these PPC crooks work is they approach businesses & convince them that they need to have their parking managed & offer to do it for free on condition that they can keep the parking charges that they levy. They then maximise their income by overzealous ticketing & unwarranted charges.

    I am sure in the OP's case that Pampurred Pets have no problem at all with people using their car park when the shop is shut. What the business will eventually discover is that customers will be be deterred from using the shop because of the disgraceful behaviour of the parking company.

    The way PPCs work was highlighted by the case of Parking Eye versus Somerfield Stores where the supermarket chain got sued for cancelling their contract because the behaviour of the PPC was adversely affecting their business. Somerfield lost & had to pay damages for loss of earnings but in the course of the case the cowboy antics of Parking Eye were revealed in detail.
