I have just dropped a line similar to what you have said to mention through the case.
    Thanks again for the advice.

If that doesn't work then as you have already said, just wait until day 3 from the date tracking shows item received back by seller- and call ebay.

You have tried to avoid seller getting a strike, there isn't much else you can do unfortunately.

I had a case against me recently and my funds for the amount of the dispute were frozen, but only that amount- I was still able to use my paypal account to buy and sell but had no access to the monies being held.

Item was returned and in the dispute console I had the choice to refund or dispute the returned items. If I clicked 'refund' it asked me whether I was sure I wanted to make a full refund and did I have the item back. I clicked yes, and my funds were automatically unfrozen and refunded direct to the buyer.

As I had refunded within 3 days of the item getting back to me the case does Not appear on my dashboard. However I did get a warning that if I did not refund in those 3 days once buyer stated my item was back with me then ebay would take over and the case would show on my expanded dashboard.

In fairness once the dispute was open I was worried about how to proceed because it does not make it clear that agreeing to the refund actually releases the funds from paypal. I had looked in paypal and could not have refunded there even if I had wanted as my funds were frozen and the refund button gone. The ebay dispute was a bit confusing, and I had intended , once I got the item back, to click on the 'yes I want to refund' button and then add a message asking ebay how I could do this when my paypal was frozen. As I said above though it was automatic after that point. It certainly could have been clearer what the process was though

I don't think the funds have been frozen due to a dispute - i think paypal have thrown the seller off - thats the only time the 180 days rule kicks in.

The reason for the 180 days rule - is so all buyers with disputes can get a refund from the account using any monies remaining.

Of course, the account may be empty - which would further prevent the seller refunding - but buyer protection should kick in then.
  • So ok, I spent all last night searching paypal for answers to refunding with a limited paypal account. Basically its up to the seller to contact PP and they will issue refund on his behalf. I sent him a helpful msg describing the process that i found on PP site.
Anyway still no refund - and now the item has been removed from eBay - so no way of leaving feedback.

I got onto ebay live chat and they say to leave it 8 days until i can escalate. So more waiting - it clearly states that you CAN refund with a limited account - turns out my seller WONT refund with a limited account.

    Oh well
