That's what I call illegal.
I can understand such exclusions on unlimited tariffs (tethering can cause much higher usage), I can NOT understand on limited data package
My tariff is 1GB I paid for and it should be my decision how I will use it.
I do have separate mobile broadband SIM in MiFi, but sometimes I need to use my phone SIM as backup (in case of poor reception, for example).
And - again - there is no single word about tethering (so it is allowed) on my tariff T&C. And still 3 says it is not allowed, because of other tariff T&C.

I don't think you need to understand why these exclusions are there, you just need to know that they are. I also don't think that it's illegal.
