The whole private parking business relies on misrepresentation of authority. They are not the council, police or government, so they can't legally issue fines or penalties. All they have sent you is a civil invoice, which you have no legal obligation to pay or acknowledge.
Contacting them is generally a waste of time, their appeals process is worthless as it is not run by an impartial third party but rather by themselves so it's obviously within their interests to reject it.
Over 99.9% of the time they will not take you to court, because the more times they take people to court, and lose, the more chance that other members of the public get to heart hat the invoices can be ignored. This would then lead to parking companies having no income because there would be no more gullible people left!
Taking people to court actually hurts their business ... Which is why they hardly ever try it.
Out of over 1.1 million private parking invoices issued last year only 49 were heard before a court and the parking companies lost half of those.The word "gullible" isn't in the dictionaryTickets: 19 [cancelled: 18, paid: 0, pending: 1]

That letter is just a wee bit naughty.
There is no way that they would ask for a NPO, as I believe they are really expensive and even less chance of being granted one.
The pre-estimates of loss cannot involve staff costs etc as these are business costs and they would incurr them where they invoiced you or not and have already been ruled illegal by a higher court than the County Court. I think it was an Upper Tax Tribunal or something, one of the more experienced posters will be able to tell you exactly what it was?
If I was you, as I like making mischief, I would email them back asking them to explain, why they believe the UTT is not binding on them and daring them to apply for a NPO?
But that's just me, best option is just to ignore and have no contact with them.0 -
Thank you everyone for all the quick replies...I was actually worried there for a second...is it not unusual for a private parking company to email you, has anyone had any past dealings with parking collection services....like I mentioned earlier I really am tempted to write to them and tell them exactly what I think of them, or would this open me up to be prosecuted
It's not unusual for them to email you if you emailed them first!

Can I ask why you bothered to take the bait? It's a scam, you only have to Google the name PCS or the PPC's own name from the fake ticket and you'd see hundreds of forum threads about these companies. Loads and loads of people have posted on here about getting letters like these (but most do not reply!).
You should have just ignored them, you have spent far too long replying & phoning up about a scam akin to a series of phishing emails - and you wouldn't reply to them!
No harm done. IGNORE THEM FROM NOW ON.

A version of that letter is there, so are others from PCS, just play snap with each letter until they give up. People have been getting an ignoring these phishing (fake) PCNs for years.

Dear Sir,
I understand from your letter that you are contemplating being the first ever Parking Company to apply for a Norwich Pharmacal Order to force me to divulge the driver details.
I look forward to that happy event, and will not be divulging the driver details to you in any other circumstances.
As you will be aware, you may only pursue the actual driver for your invoice. Any other correspondence from you, apart from actual court proceedings, with therefore be viewed as harassment on your part.Dedicated to driving up standards in parking0 -

Presumably, even if they did get an NPO issued. All that would happen would be that they found out the name of the driver. The driver would still be entitled to ignore the unenforceable invoice as they can now. The net result would be that the invoice was being ignored by somebody different.I can afford anything that I want.

Yes, precisely. Also, 'I don't know' is a valid response, although not suggesting anyone lie in a court, although if the RK genuinely didn't know...
Also, its actually more for documentation relating to the driver, for example a company with a car fleet, or a Hire Company, not for private individuals.
Are they really going to fork out £400 odd in the hope of claiming £150 from the driver?

I was just a little taken back by the parking companies email, especially when they advise against reading forums!...
I suppose the reason I took the bait (so to say) was because I initially spoke to them by phone, there attitude compleatly stunk, the girl I spoke to was rude and obnoxious...I know I should of left things at that point,,however I decided to email the idiots instead0
