Update - the claimant pursued it all the way to the small claims court and their claim has been dismissed! Fundamentally, it came down to inadequate signage. My advice - take all the photos you can, from all angles, so the location of your car and all relevant signs will be clear and also the wording of the signs. The key sign gave no warning of a charge for this particular "offence" so the judge ruled that the contract couldn't have been complete.

Very happy that the principle was won and the effort paid off. Even better that the claimant had opportunities to settle or drop the case but ended up sending two people to court to lose.

They trumpeted their BPA accreditation and the standards they have to keep to but, the moment I pointed out all their many breaches of the BPA Code of Practice (like using the word "fine" for starters), they were saying they had 3 years to comply - even though it was the older version of the Code that applied at the time of this case! I think the judge saw straight through them.

    Sweet.

I think it just goes to show that not all the advice on here is good dont pay dont pay ignore ignore... however you look at it you are gonna be paying for that ticket...

Did our own defence. Kept at it because the principle mattered and we believed we were right. They took us all the way to court, we submitted our defence and we won.

However I look at it, we didn't pay for that ticket. They may not go away but they can be beaten when your case is stronger.

    Well done to you
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Hi Saltedge, just saw this thread again. :T:T

Now that you won in Court and (presumably) this little fish of a PPC didn't appeal the decision, I wondered if you could tell us your case number/date and County Court so that we can quote the decision in future cases for newbies who are defending a PPC small claim?
