Thank you everyone for your advice on this matter I have clicked on the link and it has been most helpful:). I was unaware of how the equality act worked but that piece of information was extremely valuable and am very tempted to follow up by sending a complaint letter to DVLA and an a POPLA appeal just for piece of mind.
I'm a very strong minded person and very thankful I did my research instead of listening to my friends and stummbled on here. A friend of mine did get a parking ticket off a traffic warden and she's had all sorts of problems but I did explain that was a completely different kettle of fish and she shouldn't have ignored it as she did have the baliffs come knocking and I think that's what frightened me.
I shall wait and see if I receive anything back from them as I have checked with the post office and both letters to CEL and the store have been received and signed for. I cant say I'm completely at ease with it all but I think that's because I'm always thinking bout my children first. But Many many thanks to you all:):)0 -
Hi all Thank you once again for the valuable advise you gave. Today I received a letter from CEL confirming the cancellation of the parking enforcement notice. As you can imagine I was over the moon I do hope that anyone else that ever gets one of these notices stumbles across this site and listens to the advise they are given and has the determination to fight.

Well, I have ASKED for a ticket(I parked considerately to the landowner by the way) and when I explained what I would do, make them go to DVLA(cost them £2.50), then I would 'appeal' and if they did not cancel would use the POPLA stage which would cost them another £32.....he walked away w/o giving me a ticket. So, if one is there at the time a ticket is about to be given to your vehicle try the above and you might not even get one in the first place! Edward is it not better to deliberately obtain a ticket so they incur the costs. firstly the £2.50 to DVLA then hopefully the £27 to POPLA

Well, it was a case he spoke to me first and I couldn't resist telling him I wasn't bothered and why. I was still surprised when he walked away. I just gave this occurence just in case someone in a simliar position wanted the really quiet life(instead of ticket-appeal- POPLA-ignore threats etc for months). The thing is he won't even bother with me or my car(seems to recognise it!) at all now when I visit same car park(one half Aldi and Parking Eye, the other a PH and NPE).Got a ticket from ParkingEye? The next thing is to take the junk mail to Asda and ask for an exemption to the arbitrary time limit due to your family's medical conditions. We know Asda can do this because we've seen it mentioned on another thread. Not only would they be in breach of the Equality Act to refuse, but in fact they should already have put such a reasonable adjustment in place under the Act - consideration to individuals' needs has to be given BEFORE the event, not wait till they get a complaint and then do so.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Well I still haven't received a reply from the complaint I put into the store so I have drafted another letter stressing my disgust that they haven't had the consideration to even contact me and acknowledge my letter I shall include what you have said above strike while the irons hot as they say. I have a disabled badge for my lad with cerebal palsy and whats annoyed me is I'm not one of these people that take liberties and use it when he's not with me I park properly and just struggle. Shall keep you informed on whether I hear back from them.

Yes, do as atilla says; he seems to have inside knowledge about who to complain to at Asda to get best results.

Include with your letter of complaint to Judith McKenna, a printout of that reply regarding the Greenhithe store and ask why YOUR local store is breaching the Equality Act 2010. Why is there not a UK-wide system of Asda making efforts to exempt their disabled and elderly customers from the arbirary time limits the PPC imposes? Do they realise this breaks the law as they are not making reasonable adjustments when they KNOW there is a disability law issue here and knew about it years ago?
Enclose this printout too, from a BBC article from nearly 3 years ago (pre-Equality Act so it mentions the old 'DDA' instead but it's still a relevant article). This shows that the Supermarkets WERE well aware of this issue years ago but did nothing:

The Supermarkets MUST make adjustments because it's clearly eminently 'reasonable' to consider that that their disabled/elderly customers may need more time than able-bodied customers. The adjustment needed is a simple one and they cannot wriggle out of it - ignorance of the Equality Act is not a lawful excuse for discrimination and harassment.PRIVATE 'PCN'?
