Civil Enforcement Limited, Court Papers

So after just two letter from these hillbilly's they stopped for a month..........until this morning.

I have today received some amusing 'court papers' asking for...wait for it...£425!! No stamp, no claim number...

Heres the thing, they have also said in the same letter that they are still willing to accept £75 in full payment! how nice of them.

They have also said that this needs to be paid before the 20/11/2012 but funnily enough the sent date on the envelope is 22/11/2012, something not quite right there i hear you say!

  • It is worth ringing the number for Northampton to check that it is not genuine. At best, they may get in stook for misrepresentation. At worst it may be real (99.9% not real) If real come back.
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.
  • I agree with ringing the court just to check.

    The more times they have to tell different people that the court papers they have been sent are fakes the closer the PPC come to getting some very unwanted attention.

    as above, double check that the papers are not real, then fight back.

    Get in touch with trading standards, and contact the company that owns the car park ( as well as the car parking company) to issue a letter before action stating that unless these threats stop imediatly you will be taking action against them for harrasment.

    If these papers are indeed fake ( as has happened before) then this behaviour is totaly unaceptable.
    The parking company will just keep on doing its thing, as long as someone lets them operate in their car park.
    Those that allow the PPC to operate on their land should be made well aware of what they have gotten into bed with, they are responsable for the actions of thier agents, and it is the car park owners against whom action ( for harrasment etc) should be directed at.

    I know these tickets are by and large nothing but unenforcable threats, but there are countless people out there who dont know exactly what a private parking ticket actualy is and who will fret, worry and eventualy pay up some hard earned scrimped and saved cash that should be spent on soemthing else ( heating bill/food etc)
    Its bad enough when you know about the private parking industry and recieve threats of this that and the other ( the letters always seem to sow some doubt in my mind) if your totaly unaware of how the priate parking industry works things can be much much worse.

    I would report them to the Office of Fair Trading and to the BPA citing a breach of their Code of Practice. Not that the BPA will do much at all but the more complaints the better, and copy in the DVLA as well on this email:

    Nope no need to ring the court at all( although you can for your own peace if mind) its a standard cel ploy. They often send out draft court papers with no intention of going anywhere near a court. Also as the letter came with it means it came direct from cel so again very safe to ignore:)

    They do it all the time
    For everthing else there's mastercard.
    For clampers there's Barclaycard.

    If it goes anywhere near a court, the judge will laugh.

    Why claiming for £425, when you will be happy to accept £75. Case dismissed.

    The deluded world of CEL and their 105 day appeal process with them, without going to popla, you'll probably die of boredom by the time they deal with it. And their scales of justice above their name is really pushing it. But once a scammer always a scammer

    Our appeals process (which must be followed in step by step order) is as follows:-

    1. Your appeal should be sent to us in writing within 28 days of receiving your ticket. The address to send your appeal to is printed on all of our tickets.

    2. We will respond to your appeal within 14 days of receiving it. If at first we only acknowledge the challenge, we will write to you again within 35 days accepting or rejecting your appeal.

    3. If you are unhappy with our response you may ask us to send you the form for a ‘Manager Review’. This will provide you with the opportunity to have your appeal and our initial response reviewed by our Appeals Manager.

    4. We will respond to your Manager Review application within 14 days of receiving it. If at first we only acknowledge the Manager Review application, we will write to you again within 35 days with the full Manager Review response.

    5. If you are still unhappy with our response you may write to our Customer Service Director for a final review off the matter.

    6. Our Customer Service Director will respond with our final review of your application within 14 days of receiving it. If at first we only acknowledge the Customer Service Director review application, we will write to you again within 35 days accepting or rejecting your appeal.

    7. If our Customer Service Director makes the decision to reject your appeal, this will be our final position on the matter. With any such rejection we will send you the details of Parking on Private Land Appeals (POPLA) – the Independent Appeals Service. If you use the POPLA Service, and your Appeal is unsuccessful, the full Parking Charge will apply and you will not be able to pay at the reduced rate.
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    The charge falls within the British Parking Association’s recommended guidelines for car park enforcement.


    Of course neatly forgetting that the charge must be a genuine pre-estimate of loss by the landowner. Even the BPA COP says that. It seems that many PPCs are taking the "up to £100" figure in the COP as meaning "we will always ask for the maximum".

    What about this:

    Your blue badge does not entitle you to any parking privileges on private property. We would refer you to your blue badge handbook for more information.

    So that means you can't get a fake PCN for not displaying one then.
