The BofE don't hand out real bank notes in return for known counterfeit notes.
This what their website states:
"If you think a note that you have is a counterfeit you must take it to the police as soon as you can. They will provide you with a receipt and send the counterfeit to the Bank of England for analysis. If the note is genuine reimbursement will be made in full.
A counterfeit note is completely worthless and it is a criminal offence to hold or to pass on a note which you know to be counterfeit.

So that's why I lost my fiver ... not such good news OP ... we can't flush out the criminals afterall with prudryden's idea ...
Dammit, why do we have to tolerate so much fraud in 2007?? Organised crime really is getting the better of law enforcement.
Loss of this £500 is now likely to be an unsolved mystery that only lawyers will profit from.
In itself it is likely to be just another cost of fraud borne by innocents just like the reason behind recent credit card interest hikes I think.
I think you now have to allow that it could even be your father's bank that is at fault, however unlikely that might be, the Estate Agent/Lettings Agent will be bound to suggest it as a possibility. I feel for you.0 -
Once again, thanks for the replies.
We are in the property. By the time we received the phonecall (an hour and half after signing the contract) we had moved most of our stuff into the house because we had loaded up a few cars prior to the signing of the contract, and had a few friends helping out, so it got done pretty quick. It was while I was back at my previous property collecting the few bits and pieces left over that I received the phonecall.
In all honesty (without naming names, and making accusations), there are too many indiscrepancies in the managers story for me to simply think they had nothing to do with it. As I said, he changed his story 3 times. He demanded I go up there alone for some reason. He never phoned the police straight away, he only did so once we told him we had phoned the police, and seemed a bit panicked by us doing so.
I can't say though. There's no proof as of yet, until the police do indeed carry on with their forensics on the notes. If the bank tellers fingerprints are on the notes, it proves it came from the bank, and all will be sorted. If not however, then we have another dilemma. Im not even sure if the police can retreive fingerprints off bank notes.
I'd like to thank everyone for their input, and rest assured, I will inform you all as and when any new information comes to light.0 -

with regard to owing the agency money - they cannot take you to court for possession of yor flat until you are two months in arrears - so whatever you do, make sure the rent gets paid BEFFORE the due date each month and they cannot take you to court for this. if you are even one day late, that constitutes a months arrears in the eyes of the court. You have signed a legally binding document for however many months your tenancy agreement is, so, dont worry about them trying to evict you - they cannot give you notice until 2 month before the end of the agreement period unless you break the terms of the agreement.
Stay put, stay calm, dont let them harrass you. if it was me, just for my peace of mind, i would change the locks but keep the old one so you can replace it on leaving.0 -

I know we have done no wrong, so as you say, it's just a matter of keeping on top of things and making sure they don't try and screw me over. I spoke to our actual landlady after the incident and explained it all, and she's very sympathetic to our case. She also popped round last night to ensure everything was ok, at which point I had a better chance to explain things to her. She's confident it will all be sorted and we can carry on as per the contractual obligation without any hassle.
As for the changing of the locks, I did consider this the other night. Im going to change the mortice lock rather than the yale lock, so we can pretty much bolt the place shut when we're out. Although, should they try and do anything, I believe they would be in the wrong there.
Anyways, like I say, I shall inform you all of any progress and updates as it happens. At the minute Im in a bit of a limbo state, not knowing what's going on. I'll give the police until the start of next week. If they haven't got in touch by then, I'll be phoning for some updates form them.

Why is that?
If this went to a criminal court case in front of a jury you would surely need to know that the jury was not prejudiced by anything they'd heard previously. I don't see too many other threads on here about a £500 cash payment including fake notes? Someone says "Oh I read about that on the internet" and the defence can make a case for the jury being influenced. It's all a matter of a fair trial and no prior bias. I'm not saying it's going to happen, just that we need to be aware of it.peterbaker wrote: »Seriously? A Jury will be advised to deliberate on the contents within the trial and to ignore all else. Any juror suspecting that another is introducing (hearsay) evidence from outwith the court can report them.0 -
Should I not have posted this then? I was careful not to name names, or imply who I think was to blame. In fact, the only details I have given I believe is that I am based in Birmingham. And my first name.
