Stone in ring a different shade

I had a ring bought for me by my husband, he bought it online.
Since receiving it though we've realised that the blue stone in the middle is a different shade from the one in the pic - to me it looks blackey-blue (ie very dark blue) whereas in the pic it looks a lovely mid-blue shade. It really makes a differnce to the look of the ring and to be honest I don't really like it as it is!
Am I entitled to return it or will they treat it as a bespoke item as it was made for my size?
They have no returns policy on their site!

What type of stone is it? It might not just be the shade, but it could be a serious issue of quality being misrepresented. Eg. cheap sapphires can often be very black when they've been photographed with the benefit of massive lighting from all sides and photshopped to look the preferred cornflower blue.0

You can return it under the DSR even if it's not faulty, within 7 days, if it was not bespoke.
May be the picute online was taken using a flash, which would have the effect of lightening the blue colour?"You were only supposed to blow the bl**dy doors off!!"0 -
its a blue diamond - and it does look a kind of cornflour blue in the picture but a blackey blue in real life. In fact when I look at it on my finger it just looks a dull navy blue.
Thats what I was thinking - about the ring being taken with a flash but the pic looks like a computer generated pic, so i think they've misrepresented the colour of the stone.
I dont think this should qualify as a bespoke item, but even if it did - the difference in stone colour from pic to real life should be enough to merit a refund shouldn't it?We got rid of the kids. The cat was allergic.

Does it say on there that the pic may or may not be a exact match ?
Sometimes they have a caption For display purpose only or words to that effect.I think the surest sign that intelligent life exists elsewhere in the universe is that none of it has tried to contact us.0 -
just had another read of the page and nothing to that effect. It just says diamond colour - blue.
I think I need to call them and see what they say, my only worry is they will say this ring is a bespoke item, because it was made to my size - but not sure if this would be correct or not! Its not an unusual size ie very small or bigWe got rid of the kids. The cat was allergic.

Can you link for us please?
Admittedly I dont pay much attention but the only blue diamonds I have seen were very pale in colour and was more similar to a topaz. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
Did you select the size from a drop-down-list on the website?0
-
Ahh thats a good point - we ordered over the phone but you can buy online and yes you do select it from a drop down list.
I read this on the DSR gov site:
Made to order
There is no right to cancel goods that are made to the customer’s own specification. Therefore, products may not be returned if they are genuinely tailor-made products. If they are put together by combining off-the-peg options, then they may be returned.
Can I link to the page?? I think fancy blue are an intense blue diamond but they are not meant to be dark blue. Admittedly the site says blue which covers any shade, but its the photo which is misleading..

They do:-
7. Under our 7 day money back guarantee, if you are not happy with your goods we will provide you with a full refund providing that goods are returned within 7 days in the condition sent by Royal Mail Recorded Delivery. We cannot accept the return of earrings unless they are faulty or rings that have been engraved, specially made or resized to fit. All custom made rings including wedding rings are excluded from refund.0 -
Yes you can technically return it under DSR. When did it arrive? And of equal importance, when did they advise you of your cancellation rights in a durable medium? (Email counts as durable).
http://www.rocksroundtheworld.co.uk/index.asp?function=TERMS (item 12) only talks about image size, not colour, so you would appear to have rights under SOGA due to misrepresentation.
And at £2200 I'd want to be perfectly pleased with the purchase ... that amount of outlay deserves a happy customer.
