I presume you contacted them within 7 workings days after delivery and cancelled under DSR ?

If not then you are using there own return policy and you would be agreeing to those terms. *

    * IMO i may be incorrect im sure someone will clarify :)

Op states the vacuum was purchased in October so it's safe to say the 7 working days have now passed.

So it really comes down to whether you've just bought a cheap, carp hoover or whether it's faulty - if the latter you would only really get a repair.

The OP also said the day it arrived they tried it, then boxed it up and returned it the next day.

So to me reads that they returned it the day after they received the hoover.

I don't know if Very are within their rights, but either way they are not doing themselves any good by refusing a return, are they?

Having read this thread would you buy an electrical from Very? Ah well, relax and have fun with this erotic fiction.

Personally just due to the sheer number of threads (and the nature of the threads) we've had on here regarding Very...............I wouldnt buy anything from them.

You can't return under the Distance Selling Regs if you have used it, you are rejecting under the Sale of Goods Act but you should have written not just boxed it up and sent it back.

Actually, yes you can. The right to cancel is unconditional. But the retailer can pursue you for any diminished value the product has.

As i've commented several times over the past month, the law is actually being changed to make this clearer but will also allow the retailer to make a reduction in refund given as opposed to now, where the retailer should give a full refund and then pursue separately.
