Very wont accept return

Hi there, I bought a vacuum from very.co.uk in October. The day it arrived I plugged it in and it didn't pick up half the dirt my old vac did.

I then boxed it back up and arranged a return for the next day, stating poor quality.

Very are now saying I have to pay for the item, as I plugged it in and used it i cannot return it.

They advised me in their terms and conditions it states this.
Well I've searched but cannot find this information.

Do I have any rights to a refund?

    I'm not an expert on electric goods, I would say they can't refuse, under DSR, but here's a guide about dsr:

    Dont shout at me if you have tried this but....does the hoover have any settings? Most upright hoovers have some sort of setting for raising and lowering the brushes.

    First thing it states is item must be unused, though how that stands in law with regards to electrical goods I'm not sure; you do have to use them to find out if they work properly after all.

    Very are on very shaky ground. DSR allows you the opportunity to inspect the goods. For electrical items I'd argue that checking that they actually have power is part of that inspection.

    However, that's not what the OP's trying to invoke anyway. He/she (probably a she - have you ever heard of a man who vacuums?? ;)) wants to return the cleaner because it's rubbish. The SOGA covers such instances (although 'rubbish' is a bit subjective) and the cleaner being used should be no barrier to a successful claim.

    I hear terrible things about very. I bet John Lewis would give a refund - no questions asked.

    Yes - me. And I have done for 20-odd years (it's my usual Sunday AM ritual). ;)

    I think someone wants you to think it's not him being lazy, that's how all men are and you just have to put up with it... :D
  • Thanks for all your help, I'm going to write them an email this evening throwing everything I can at them and hope it gets me somewhere.

    Just to chip in my husband occasionally vacuums, just not very well ;)
