  • All that is fine, but the onus is on the OP to prove that the fault is not due to misuse.
    Without this proof it is pointless them contacting Comet or a credit card company.

    Yes, some proof may be needed, but then that's the case whenever you take something defective back to a supplier. Nothing new about that.

    Not always.
    It all depends when you take the goods back to the supplier.
    If it it less than 6 months from purchase, it is automatically assumed that the defect is due to a manufacturing defect and it is up to the supplier to prove otherwise.

    It is only after this 6 month period that the consumer may be asked to prove that the problem wasn't due to misuse.

    Got no chance with comet, they are not offering refunds or repairs on the items they are selling today.

  • I am guessing this is a Samsung PS43D490 - we have the same one!

    If this happened to ours and we had bought it from a now defunct company I would firstly contact Samsung asking them for a repair, if I got no joy from them I would go the Credit Card route.

    I would not mention the SOGA in your first contact with them, only if they refuse to help in the first instance would I then mention it.

    Did you register it online? Would be useful if you did, you can then contact them under your log in on there.

    The OP will have to invest a considerable sum upfront in commissioning an engineer's report to make any claim under SOGA, with no guarantee of success.
    He/she has to prove a pre-existing fault. Comet don't have to prove anything.
    No free lunch, and no free laptop ;)

    Thanks for your replies, it is indeed the Samsung one!

    I've not bothered to contact Comet as I noticed that they have signs all over the place saying they won't be doing refunds or exchange.

    I have contacted Samsung and am awaiting their reply. I think I did register the product when I bought it.

    It's definitely on the blink, sometimes it works sometimes it doesn't. When it does, it'll freeze after a while....

    If they don't get back to me with an appropriate answer, I'll be coming back for more advice!

    Do a Google search to see of this problem is prevalent on that model. This will make it easier for you to get Samsung to fix it if you decide that is the best route for you.
  • Just to let you know, Samsung said I'm in warranty and are sending a technician out to assess what's going on.

    Typical that it's started to work OK now...
