I got what I wanted from Tesco a replacement Blu ray the same as the one Ibought and I didn't have to pay the extra money they said I would have to.
I rang the government consumer help line and they said I was correct (see myfirst post) that I was entitled to like for like or spec for spec exchange atno extra cost. Shaun I hope you are reading this.
As for the price I paid for said LG Blu ray player, in Sainsbury the samemodel was £129.99 and in Tesco I paid £34, so technically I didn't buy a cheapthrow away item I got a real bargain.
I will however in future just contact the experts who know the law and notpeople who just have an opinion.
Stand up for your rights everyone! I hope this has helped you0 -
Can I ask Bris, what qualifications you have to be able to answer this post?
It quite clearly states I the Blu Ray Player from Tesco for £34.
I phoned Citizens Advice consumer service tel no. 08454 04 05 (you can find a normal number on say no to 0870).
This is what I was told .
If they still have the same item, I can have mine replaced under the sale of goods act regardless of what I paid for it or that I have had it for 11 months
The others things they can do is repair it (they didn’t want to see my first post)
Or give me my money back (this they did want to do) but I wanted the Blu Ray player.
You can if they refuse to replace your item take them to the small claims court at a cost of £25 because they are in breach of the sales of goods act.
They know this, but they think by giving you your money back you will go away and if you read the posts on this that is what everyone has said YOUR GETTING YOUR MONEY BACK WHATS THE PROBLEM.
I think differently you should get what you are owed by the law not what they want. It is your consumer right.

So basically the citizen advice people agreed with everyone else on here that they can just give you your money back and don't have to replace it?
There is no consumer law that says they have to replace the blu-ray player. They can legally just give you your money back.
If they did swap the blu-ray player then I imagine they did it not because of any consumer rights you may have, and more to just get rid of you. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -

Just for your peace of mind. I got a BD550 last year as well from Tesco only it cost me £27.99 I was quite pleased about that, sounds like you paid massively more than you had to. It was never ever on sale elsewhere for £130 its basically the entry level LG Bluray player.
Take your money from Tesco. Money in you hand is worth more than a broken cheap BluRay player.0 -

Perhaps you should take a look at actual legislation before passing judgement on who is wrong.
http://www.legislation.gov.uk/ukpga/1979/54/part/5A(3)The buyer must not require the seller to repair or, as the case may be, replace the goods if that remedy is—
(a)impossible, or
(b)disproportionate in comparison to the other of those remedies, or
(c)disproportionate in comparison to an appropriate reduction in the purchase price under paragraph (a), or rescission under paragraph (b), of section 48C(1) below. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -

Helpfully, Unholyangel has posted the significant bit in the post above.
Do you now understand where your thinking is wrong?
If not, feel free to ask for further clarification.0 -
I don't know the ins and outs of legislation, and I can see how the OP finds it hard to believe people here rather then the 'experts' from CAB etc.... sadly you have the same chances of a post being correct as you have of 'official' advice being correct... at least on MSE you get more people answering and more chances of getting the correct information, and they'll give you pointers to find the right information for yourself....
I would rather ask here and then research the information provided than go by what the CAB advise me to do, personally (and I'm not getting involved in who is right or wrong here, because that's not the point I'm making. just being objective...)0 -

Grab a napkin OP, you just got served.
I wish people would just admit when they're wrong.
Having worked for CPWs warranty exch and repair team for nearly 3 years, no they don't have to replace.0 -

Yes, I've just read it.
Whenever I'm shown to be wrong in what I post, I will always come back on here and admit it, but as I was 100% in my earlier post, I will happily stand by what I stated.
Now that you have had ample time to read the SOGA, especially the relevant paragraph as clearly shown by unholyangel, will you be willing to do the same and admit that what you believed and and what you were told by someone on the telephone is wrong?
As you brought up the Citizens advise helpline, what does their website state about this?

When the trader doesn't have to give you a repair or replacement
A trader doesn’t have to offer you a repair or replacement if it’s going to
cost too much.
If the trader can't offer you a replacement or repair, they should
either:
offer you a partial refund if you return the item, to allow for the use
you've already had, or
let you keep the item and give you a reduction in price for the
fault.0
