Tesco and their bought out guarantees

New member and my first post to the forum.
I bought an LG Blu ray last December from Tesco for a half price at £34.
Well it has gone wrong, so I phoned LG about getting it repaired and was told Tesco has bought out the guarantee and I would have to talk to Tesco.
I rang them today and as the price I paid was so low they wouldn't repair it, I can have my money back or exchange the item. But here's the rub, if the same make and model is more expensive I have to pay the difference.
Is this correct? the man on the phone was quoting the sale of goods act and saying these options are best for Tesco.
Can anyone help, should I not have been told if the item I am purchasing is no longer covered by the manufacturers guarantee?

    The person you spoke to is correct, you cant expect more than your money back here.

    You've had the use for the BluRay player for nearly a year, and now they are going to give you all your money back. That's as good as you can expect.

    If they were feeling awkward, they would deduct a percentage for the use you've already had.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.

    But the point I was trying to make is that if Tesco have an LG BD550 in stock for £60 and I bought my LG BD550 for £34, I would have to pay them the difference, because as they say it is on the price not the model.
    So if you ever get something in the sale you are stuck with having to pay them full price if it breaks.
    Forgive me if I'm being naive, but this can't be right?

    Why not?
    Giving you a full refund is actually more that the minimum that the law states is allowed.

    If an item fails within a reasonable time, you can ask the retailer to provide a repair, replacement or a refund but the retailer can decline whichever option you pick if it is disproportionally costly in relation to one of the other options.

    If they do opt to give you a refund, this doesn't have to be the full price paid as they are allowed to make a deduction to cover the use you will already have had from the goods. (it is rare for high street retailers to do this, but it is permitted for them to do so).

    Price is a factor in deciding the quality/life expentency etc of an item. You wouldnt expect a £20 microwave to be as good/last as long as a £200 one (thanks bod :P).

    And no you're not stuck having to pay them full price. You can buy elsewhere :)

    Essentially they couldve offered you £20.....SoGA allows for a partial refund to reflect use you have had of the goods. Sorry its less than ideal but look on the bright side, hang off till after xmas and you might bag yourself another bargain AND have gotten use of a bluray for a year for free!

    Actually I WOULD expect that. In fact I'd expect the £200 one to be MUCH better and last FAR longer than the £20 one. ;)

    (You have the £20 and £200 the wrong way around). :)

  • Actually, I think Unholyangel might have had it right the first time.

    I have an old Philips microwave in my workshop, and it's at least 18 years old and still going strong.
    It doesn't have any LED or LCD display, the timer is totally "clockwork" and there is no rotating turntable.

    About the only thing that could go wrong is the magnetron and these are normally extremely reliable, unlike modern units that have all manner of bells and whistles, (microprocessor circuits fans, turntables etc.)
    The more complex something is, the more there is to go wrong with it, so a cheapie £20 microwave may well last longer than a £200 all singing and dancing one.

    George, while true for old machines,' you'll find most £20 machines will try and do the job of a £200 machine however your have to sacrifice quality either in workmanship or quality in parts.

  • How can everyone get so off topic.

    I got what I wanted from Tesco a replacement Blu ray the same as the one Ibought and I didn't have to pay the extra money they said I would have to.

    I rang the government consumer help line and they said I was correct (see myfirst post) that I was entitled to like for like or spec for spec exchange atno extra cost. Shaun I hope you are reading this.

    As for the price I paid for said LG Blu ray player, in Sainsbury the samemodel was £129.99 and in Tesco I paid £34, so technically I didn't buy a cheapthrow away item I got a real bargain.

    I will however in future just contact the experts who know the law and notpeople who just have an opinion.
