That is actually quite good advice. Unfortunately for poor Dom (the OP) it comes on the back of following poor advice on page 1 of this thread. He need never have accepted the phone back in the first place.

No,of course he didn't need to accept the return.
But as it was sent tracked, all the buyer has to prove was attempted delivery. As soon as paypal receive the attempted delivery details the buyer would be refunded.
If the buyer had a return address on the packet,he would then receive the phone back as well as a refund.
    Outstanding advice! :rotfl:
Instead of spouting off about "bad advice on page 1",i think you should get your facts right first.Anybody taking advice from you in this thread will lose money.

The trouble is that if a buyer said the item was faulty (even if it wasn't),Paypal would ask the buyer to return for a refund.
If the seller then received the item, and the item was tracked, all the buyer would have to do is upload the tracking details for their refund.
It wouldn't matter one bit if the item had no faults or if the seller was a private seller, they would be refunded in this situation.
Most people know that private sellers have different governing rules than business sellers, but if the item is sent back tracked to any seller when they say it is faulty (regardless if it is or isn't) they WILL get their refund

So the advice for the OP should read,

"Although you are under no obligation to accept the phone back or offer a refund, we must assume that your buyer is a liar and is happy to falsely claim the phone is not as described was not working upon receipt yet still waited 35 days to bring this to your attention. So under the circumstances, the wise heads of the MSE ebay board hereby advise you to suck it up, refund the buyer his full fee and accept back a phone that no longer operates as it did when you sent it the first time. You might even want to pay the buyer, that's the guy we've already established is a liar, his return postage fees, so as not to upset him."

Phew. I'm glad we're finally all agreed.

Theres a recent case on here where Ebay sided with the seller (very rare i know).

They said if the item works when it arrives - a private seller does not have to accept a return.

Of course, most buyers will say it never worked - but thats a different discussion.

So you think following the rules as set out by ebay is bad advice?

No,following the rules is GOOD advice.
Ignoring good advice when told of the pitfalls of ebay rules is a BAD idea.
Very, very rarely will a seller 'win' in a case like this.

No, that's not buyer protection for me or anyone else.
    If it's anything, it's fraud.

I reckon she could have tried to jail break it too. I think you are better off reselling it but tell her that it is fine . Maybe google what would make this happen and tell the buyer what the verdict is!

Hi again , some interesting responses.

The buyer has not opened any case at the moment its all through eBay message.

I am going to try and string it out over the 45 day period, Once it has gone over 45 days can the buyer still open an eBay or PayPal case? or is it longer?

Also the buyer has left me positive feedback already so i dont have to worry about a negative.

    Thanks!
