IB Tribunal Appeal very soon - what to expect?

    The tribunal is next week. The documents have been submitted months ago, main one being a doctors letter supporting my wife's appeal.

    Hi again does your wife get DLA, if not she should at least get the lower or middle care allowance.Having a bad hip must mean she has problems after any length of time sitting or lying still,and going to the bathroom must be very hard if she has to go in the night.(i have to fall out of bed slowly and use my hands to lift myself up from the floor using the bed) .
    getting out of a car must also be very difficult.
    She should also get mobility allowance,going out alone in the winter is very frightening esp if slippy or windy.
    One more hint try to buy the best shoes you can afford,with the thickest heels and soles.with cheap shoes you can feel every stone and every step in your hips,and you cannot walk as far, and you are in more pain and get tired very quickly.

    I had an appeal a few months ago, after a lot of hastle I did eventually win - with the doctors evidence I am in no doubt that you will win - I'm just sorry that you have had to go through this ordeal - I can certainly empathise with you.
    These medicals need to be changed .

    It's a pity that you didn't ask the CAB/WRO to represent you at the appeal, as they are very expereinced, but you can represent yourself.

    The panel will ask your wife questions about how her disability affects her, they will have read the papers and medical reports, and if the DWP send a rep, then they will listen to whatever s/he has to say.

    They will then send you outside for a while, then call you back and give you the decision (they can adjourn the decision, but it's not likely).

    You will be sent a letter laying out the decision, and why the decision was reached.

    For people actually attending a tribunal the success rate is approx 70%.

    The appeal was today. It was quite formal. Headed by a lawyer with a Doctor in attendance.

    It lasted 20 mins and my wife is not back on IB!

    Should have read "my wife is NOW back on IB" and not NOT.

    i.e. We won the appeal!!!!!!!!!!!!!

    Only worry now is that the DWP can now appeal the appeal! (does that ever happen?)

    HI rombomb,

    If you and the doctor think your wife's condition has worsened then ring up for another claim form and go to CAB or a Disability Advice Bureau (not all towns have them) and get them to help with your form.

    Remember the appeal is to see how ill your wife was at the time the medical was done so you have to talk in a past tense so if she is ill still then reapply.

    I definitely think you need help with this form.

    At your appeal did you outline all the facts that were not true that the previous doctor had mentioned?

    Oooooooooops, typo as explained above.

    My wife did actually WIN the appeal and is NOW back on IB!

    And it was not a bad experience at all, both men were extremely pleasant unlike the DWP's previous examiner.

    Congratulations, I am pleased for you and I am sure that it is a relief that it's over - it is stressful isn't it. However I do agree with Eager_Elephant and you should now make another claim as soon as possible.

    Not quite with you there, could you elaborate? Eager_elephant thought the appeal was unsuccesfull.

    My wife is starting to feel a lot more relaxed now, she's been treated to a nice hot bath, a dose of painkillers and a wee glass of Asti.

    The experience has been very traumatic for her, quite a stressful day all round, but again I must say they were all very polite and matter of fact, unlike the previous assessment.

    noggin, do you mind if my wife PMs you to ask about your hip replacement ops and experience(s) since?
