IB Tribunal Appeal very soon - what to expect?

I am representing my wife at an appeal tribunal to appeal against the removal of the Incapacity Benefit that she has received for the last ten years.

In a recent medical examination she scored 3 despite scoring over 60 2 years and and a similar score about 10 years ago (this was the only evidence that the DWP sent me).

We paid £60 for a full medical from her GP, who supports her appeal and states that her condition has deteriorated.

Lots of the statements on the medical report from the medical examination are complete fabrications, and it is my intention to dispute a lot of this stuff.

What can I and my wife expect at this forthcoming tribunal?

    I always thought you needed to score a min of 15 to get IB?

    Yes over 15. Previous scores 60+, this score 3. Despite her GP letter stating that her condition has gotten worse.
  • Does your wife receive DLA? May I ask what medical condition your wife has? It seems strange that she has only scored 3 but her health has worsened:confused:

    If you have full support from GP and consultants you shouldnt have a problem.

    I have just had my industrial injuries benefit appeal and they agreed with me, all I done was dispute the two resons why they lowered my % and got a statement of fact from my doctor. They asked me a few questions, sent me outside then called me back in for there answer.There were two people asking questions, one would ask a question and I would answer, then the other would ask a question about the answer I had just given.

    That is exactly the basis of my appeal. No DLA. Arthritis of the hip, so bad that she needs a hip replacement but is too young to get it (early 40s).

    I had both my hips replaced at 45,nearly 10 years ago, ithink at least one of my hips will need replacing again soon.
    I have been on IB for 10 years but i have other problems too.

    be warned .in my area appeeals are heard in the county court in the main courtroom and the three tribunal members sit on a bench like magistrates.

    i hope yours goes well and you are not intinidated like i was

    I had an appeal over a year since now and although it was nervewracking it was such a relief to get it over with

    Have you had a date through for the tribunal? Have you received all the appeal papers?

    If you havent already got some help from the Citizens Advice Bureau or Welfare Rights Service, do so as they are a great help with forms, what to say and do and also in lots of cases will attend the tribunal with you

    With my IB tribunal there was a doctor and solicitor on the panel and on my side there was myself, my mum and a support worker from the CAB. Both people on the panel were asking questions.

    With the appeal papers - you should have already got or be receiving a report from the medical - go through this and note any discrepancies etc, in mine there was a lot.

    My advice is to collaborate and send in as much factual information, medical history as possible and forward this to the panel in advance.

    The people on the panel are often solicitors/doctors and are very much 'fact' and 'evidence' based.

    When i did this my appeal lasted 30 secs as they simply re-instated my IB as the evidence was overwhelming
