Charges to a cancelled card.

Hi all, been reading this forum for a while and I have a strange issue with my debit card.

Back in December 2008 I lost my debit card and had it cancelled. However, my ISP at the time (Demon) continued to take charges from it. I left demon on 24th Sept 2010, but they continued to charge me to this present day.

As my card was cancelled, who was responsible for the charges. I will be pursuing my bank for these unauthorised transactions (post my account cancellation) but if my bank was responsible for making payments on a cancelled card I may be able to pursue them for all charges made since it was cancelled.

    If you gave your ISP permission to debit your account and did not tell them to stop, then you are responsible. It matters not if the card you originally used is cancelled.
  • I told the to stop in Sept 2010 when I cancelled my account with them and switched ISPs.

    I am still annoyed tho, that a card that was cancelled was still charged, and the card would have expired in 2011 and still it was charged

    You can also tell your bank to stop paying as well now. Previously apparently only the company claiming the debit to stop the payments.
    Continous payment authority on debit and credit cards work differently from direct debits. Cancelling or changing the number on your card does not close down the account to debits you agreed to before you cancelled the card.

    You need to understand that it's not the card that's charged...it's the account that the card is linked to that is charged.

    Just out of interest, why has it taken you nearly 2 years to spot this activity on your account? NB, that's also a question that may be asked of you when you 'stake your claim' with the bank so you may wish to have an answer ready!

    You need to have proof of this for your bank and for any reclaim or compensation, such as a letter from them stating end of your subscription and the date of the termination of the contract.

    Cancelled and expired cards only refuse new transactions; since this was an ongoing transaction, it will forever continue until the vendor cancels it. However, new rules allow you to request the card issuer to cancel such payments, but it may be easier to ask the vendor to cancel them.

    If you never made any payments to this card since it was cancelled, I'm surprised the card issuer has not sent you any letters, as I'd expect in excess of £500 of charges from the card issuer by now.
  • It's essentially my wife that deals with our joint account, and I am the techie and have changed ISPs twice since I was with demon. My card was used fraudulently recently so I checked the account and noticed the charge from demon, and then looked deeper.
    It won't stop me having a bit of a fight with my bank tomorrow, I will tell them it's their fault that a cancelled card has been charged. I spent about 2 hours searching. For other instances of this, and the only occurrences that were similar were where a hold was placed on funds. This does not seem to be common where charges can be taken 4 years after a card was cancelled.

    You may want to read up on Continous Payment Authority ( which is what it sounds like you set up with your ISP) before you start that fight with your bank.

    I have an email from demon confirming my account was closed so I can use that as my evidence.

    I wish it was £500, but since the card was cancelled over £1200 was taken. Some of it was justified of course as I was still using their service.

  • Of course I am, but I will let them explain to me what the issue is. I want to act like a dumb consumer when I call them, but be prepared when they tell me why something happened.

    It's not the first time I have called a supplier or bank with outrages claims, and been given more than what I legally deserved because I was prepared.

    When my card was fraudulently used, I was on hold for almost 30 minutes, I got £20 compensation just cos I asked for it.

    I do appreciate all the advice given here, but I still feel it's morally wrong that a cancelled card can be used 4 years after its cancelled. I will get something from it as I have evidence that the contract between me and demon was cancelled so its not all bad.
