Returning a faulty pram.

Our Britax zeta travel system was a bargain and there is no way we would have paid out the normal price. It was hugely discounted in a sale at our local baby supplies shop. It is 'last year's colour' and they have none left as they don't stock that type of travel system any more.
The pushchair part has been jamming, not opening properly and not lying back to flat for our newborn. I took it back today and they have said they'll have to send it to Britax for them to have a look at it.
They offered me a loan pram but couldn't give me one that would fit the car seat on or indeed fit in our small car's boot. They did offer one that didn't lie flat, which was no good (and dirty too.) I went away without the loan pram which isn't a huge deal as we have an old one that will do in the meantime.
What are our rights regarding the pram? I think they have to repair or replace it or give us our money back. Is this correct? I'm worried about them giving us our money back as I don't want to return the car seat as it will cost too much to replace at non sale prices and the next size up is the only available stock but is useless to us as the pram is too large for me to handle and doesn't fit in our car.
She said it would take about a fortnight too. Is this unreasonable?
Thanks.

yes absolutley a repair or refund (sale of goods act) not fit for purpose, i guess 2 weeks is ok if it has to be sent away, if you have any probs give your local trading standards a call or consumer direct (but its an 0845 number ...... 0845 040506) or look on their website consumerdirect.gov.uk
good luck hope you get the result you wantmustn't grumble :cool:0 -
What is a travel system?
If one element of the whole system does not work then you have a right to the whole thing replacing as it is faulty.:beer:0 -
A "travel system" is a pram/pushchair which allows an infant seat to clip on top. This saves removing a baby from a car seat to pram/pushchair.0

It sounds as if what you want is EITHER a repaired system, or an exact replacement, which the shop no longer stocks - do other places stock them or are they discontinued completely?
Either way, to check your rights, I would contact your local Trading Standards office - there's bound to be information online, but what you'd need to check is whether you can insist on the shop getting you an exact replacement.
Of course it's possible Britax will replace it if it's not repairable: you could contact them direct if the shop doesn't HAVE to do so.Signature removed for peace of mind0 -
Thanks Sue, that's exactly what I want.May all your dots fall silently to the ground.0

I can't remember the exact term for it, but legally, the shop is entitled to make the situation such that neither of you is in a worse position than you were before the purchase took place.
i.e to refund your money, and they have the pram back.
Unfortunatey this may mean that won't be able to replace "like for like" with the advantage you had on the price when you bought it.
It may be worth buying a separate pram and car seat- leave the car seat in the car and put the baby in the pram. You'll probably pen up your choices then-and it's not worth purchasing your pram which you could potentially be using for 3years, based around a car seat which at best you'll get a year out ot.
It's much better for the baby anyway-they're not built to be in the slumped position they're in in a car seat for any length of time!0 -
You're right about the car seat and as yet we've not needed the pram in this way. He stays asleep when we lift him out of the seat and put him in the pram still. However, I wanted it because he's too heavy to lug about and I want to be able to clip the car seat onto the pram to take him in and out of nursery when I'm delivering and fetching my toddler so I don't disturb his sleep for the sake of a few minutes. I can't carry him all the way even though it's a short distance. (He's over a stone already and he's only 9 weeks old!)May all your dots fall silently to the ground.0

I totally understand what you're saying-it's the unbreakable rule of "never waken a sleeping baby" isn't it!;)
You must be feeding him some good stuff! (must dig out my red book and see what my ds was at 9weeks!)0 -
He was 13lb 13 at his 7 week check. I've not dared get him weighed since!:oMay all your dots fall silently to the ground.0

i don't drive so we didn't buy a travel system. i got a cheap infant carrier from kiddicare http://www.kiddicare.com/page/navpage?No=0&N=379
so i don't really know what i'm talking about, not having used a travel system lol! but argos sell cheap travel systems, about a hundred is their cheapest. possibly not suitable for a heavy baby though. have you looked at graco travel systems?
i don't want to depress you but it can take a fortnight to get a pram sent away yes, i hear irate mums yelling at staff in mothercare about it every time i'm in there
i hope you get it repaired, and if not that they give you a different travel system instead at no extra cost. fingers crossed!'bad mothers club' member 13
