However, if the phone 'Breaks' ie doesn't work properly then under the sale of goods act you can demand a replacement OR a refund - the choice is yours.
I would take it back to a different shop and complain that it keeps cutting out intermittently and demand a refund if I were your mate. Go on a Saturday and they will probably be too busy to argue - esp if he starts shouting the odds at the asst.
If the phone is faulty T-Mobile Retail will just replace it like for like.The fact the phone is faulty does not get you out of contract.0 -
With T-Mobile, they offer 7 day cooling off period for online purchases but have no idea about returns to retail shops. I would call up T-mobile and find out.0

Anyway, I used to sell T-Mobile contracts as well as other network contracts when working at Phones 4 U. Even though we 'knew' T-Mobile contracts had no 14 day policy as such, if a customer came in to return the phone we had to do it in the end. Our customer service team would tell us to do it so there wasn't any point in delaying the inevitable.
I don't know what laws cover the consumer, but as far as I'm aware you have a 14day cooling off period when signing any mobile contract - regardless of where you buy it and who you buy it from.0 -

"If you purchased your phone in one of our shops, under the StreetCheck Network Guarantee you have 14 days to return it to us if you are unhappy with coverage"

Thanks everyone for your replies. Unfortunately my friend is completely tied into his contract (as T-mobile don't have cooling off periods for instore sales). I ended up scouring the internet and couldn't find anything that would help him out.
So he has learned his lesson big time (silly boy that he is) and let that be a warning to any other impulse-buyers out there! :eek:0
