the other point of view is that you and the retailer have entered into a binding contract which states you give them £x and they give you a working underwater camera.
like any other contract it can be enforced and if the retailer isn't willing to fulfil their side then you can source an equivalent (preferably identical) camera from elsewhere and recover any extra costs from the retailer.
SOG gives the refund option and that generally is sufficient as most goods are readily available from multiple sellers at about the same cost but if that's not the case then normal contact law kicks in and you can enforce it.
They did supply a working underwater camera. It has subsequently gone wrong. They have offered to remedy that under the terms of the contract. You can't expect the product to work indefinitely. Not sure where you think the retailer hasn't fulfilled their side.
If the OP did want to try going down this route, age would also be something to consider. They can't expect the store to pay for a brand new one - they would need to source one that's around eight months old (as they have had eight months of use).
I think the best option is to pay the extra £30 and order the new one from the site. £30 for eight months use is a good deal, IMO, and the OP will end up with a brand new one again, which they are unlikely to any other wayCompetition wins: Where's Wally Goody Bag, Club badge branded football, Nivea for Men Goody Bag0 -
Reading this thread, it may be pertinent for the OP to change the thread title. Simply Electronics do not appear to have been "simply awful" (other than, perhaps, their speed of response).0

However to enforce it would require legal action, which may be costly, particularly if the OP loses the case which given the retailer has acted in line with SOGA, is possible. Perhaps much more costly than simply paying the 30 quid for a new one.0 -
Thank you to everyone who has taken the trouble to reply to this thread, it really is much appreciated. It has put me in a better position now to undertsand the situation here.
Just to add that the video camara was in very good condition and hadnt been used much so i would have hoped it would last longer than 8 months. Alas i guess i wiil stump up the extra but i have learnt a valuable lesson here which is that sometimes its just not worth buying on line for higher costs items due to the hassle factor should something go wrong.
Once again guys you have really helped me!!!ALWAYS A PLEASURE AND NEVER A CHORE0 -
Just for your information, simply electronics are not as I thought based in the UK and are in fact in Hong Kong, so therefore do not come under the sale of goods act or trade standards. In fact they are a bad company and if you search the forum there are other threads relating to the bad customer services they provide. I believe there has been multiply problems with this company and in short (and too late for me, trying to get back £820 as we speak) do not buy from them is the opinion of others and now me.0

Well after several months i have finally got a partial refund as they only gave me a depreciation refund which ihave never heard of before. They kept saying buy something else from them but i chose two different waterproof camaras but both times they didnt have them in stock. I was so sick of having to keep chasing them that i just wanted shot of them so just wanted some money back. They are the worst company i have ever dealt with and if i had the patience i would have fought this one but i wanted a camcorder and realy didnt want to wiat ntil the fight was over. Thank youto eveyone who gave me advice on this it really was much appreciated. If anyone is reading this and hasnt purchased from simply elctronics yet well as per previous advice avoid this company regardless of the price. If it has taught me anything well its to googel the company first and read the reviews.
Many thanks MarcALWAYS A PLEASURE AND NEVER A CHORE0 -

I did order another one but they were out of stock of it so i r=ordered a more expensive one as per their request but again they were out of that one as well so they had no more waterporoof camcorders in stock so they could not fulfill my order in anyway even as i was trying to resolve this. Very poor show from a comapny IMHO.ALWAYS A PLEASURE AND NEVER A CHORE0
