QuickQuid Taking money from my account unlawfully

Hello All,
I'm new to this site to please go easy on me :j
I had a loan with quickquid (Well I still do) and I paid £400 off it and applied for an extension to clear the remainder of the loan next month, all went through ok and looked good.
However on the 31st October, I noticed that £132.32 was pending on my account and was down as a card payment, no direct debit. This got me worried a little as this money was budgeted to buy food etc for the weekend ahead, I have 2 small children and my Partner.
This left my account with £2 in credit...I phoned my banks fraud department and they advised that I need to contact QuickQuid as this is a dispute not fraud.... Surely someone taking random amount of money from my account for no real reason is not a simple dispute.
So I phoned quickquid and after lots of them saying I'm wrong they are right, our system are flawless and this mistake couldn't have happened etc etc bla bla bla, they finally went "Oh...Ahhhh yes we admit fault here" They told me that they are refunding the money and it would hit my account within 24 hours so please check back on Saturday evening. I can tell you now Saturday day with no food in the house and £2 to our name was an interesting day.
Saturday evening arrives and this is not in my account?? So now i'm panicking but think "It's ok leave it until sunday afternoon" and still nothing...I have phoned them and spoken to another manager who is telling me it could take 24 working hours or as long as 7 working days to hit my account...Surely this can't be right as they can fund me a loan in a few hours if I wanted it!!!
The main thing I want to know if can I take legal action against QuickQuid?
I don't believe that it's right for them to behave like this, I made them aware that I have 2 little boys to feed and I budgeted that money for the weekend, they have caused a lot of undue stress my end, especially as I can't borrow money of anyone at the moment.
You're advice is most appreciated as I'm really upset by all this:(
Many Thanks,
Joe

I would say that its perfectly legal for them to do this, afterall when YOU signed up for the loan YOU accepted all their terms & conditions, which included repaying the loan back on time.
I would suggest that instead of being confrontational with them you try to be be polite and have a reasonable conversation with them and ASK, not demand they remove the marker on the £132, as you MAY get a better result.
Hope you get this sorted out in your favour.0 -
Surely you have some food in the house to feed the boys ?
Is borrowing from QQ a one off ?0 -
Yes borrowing from quickquid was a one off which has spiraled in to a bit of an issue.
Quickquid have no right in taking that money from my account as I applied successfully for an extension and paid all the money that they wanted to cover the fees etc etc, therefore they have wrongly taken the money from my account and they even admitted this at the end of the conversation.
Where does it state that they can dip in to my account as and when they like to have a few quid here and there?? It doesn't.
I haven't been hard on them I have been firm but fair especially when this money is much needed.
Yes I do have food in the house for the family, but it's not the greatest but gets us by I guess.
Thanks,

The fact you had to get a payday loan in the first place suggests budgeting issues here.
Please go the debt free wanabe board and post a statement of affairs - they will help you save money where they can.0 -
Seriously in the UK in 2012, someone with children doesnt even have more than a days food for them in the house in case of emergency. The mind boggles it really does.0

What amazes me more is the fact that in this very country at this very moment there are children who are going without lunch, tea etc because there parents cannot afford it. It's a fact of life and a part of any economy.
As stated above I have food in for the kids but I need a fresh shop of food hence budgeting for that for the week.
We're the almighty UK.... Please don't sound so ignorant and oblivious to the real world.... in 2012 people can't even afford a bowl of rice in some countries....The UK is just as messed up in a lot of ways.
Food costs money and as each day goes by it gets more and more expensive!
Just so you know the % of people living in the Great almighty UK under the poverty belt rises year on year and food aid parcels are now becoming more and more common place!!
Really bugs me people who have their heads in the cloud0 -

I'm currently speaking to National Debt line and I have done an income and expenditure form, now writing to all loan companies creditors etc with an offer of repayment, just finished opening a brand new bank account with another bank and all wages etc will be paid in to there.
Time to get a handle on this, Just so you know, I had to move house this year, a car died on me soon after moving and the new one we got broke down 3 times!!
Hence the need for emergency money. My own fault but never again, feel a little more refreshed after speaking to National Debt line...there is light at the end of the tunnel. :j0 -
