Cancelled the upgrade, phone still delivered

    In my second letter I said the phone arrived even though I had sent them a letter requesting it be cancelled, and gave them a contact number that they could use to arrange collection at my convenience.

    does sound like incompetence on threes part but by the sound of it as it stands sounds like 'to there eyes' you have a phone and you have one maybe two contracts possibly, do you not think bear in mind could have CCJ stuck next to your name which stays on a record for 6 years and will effect your credit rating for that time it can not be removed is worth not phoning them!
    Sorry seems simple to me you just being lazy now with the hope of a free phone worth £500 to do with as you wish and maybe fight it later on.
    personally i would phone them ask to speak with a manager sort from there and ask the manager to put into writing what is sorted also maybe worth asking for a copy of the call as they now all record calls 'for training purposes'
    if you do nothing you will have hell of a job sorting it out the other side.

    You have obviously come on here for advice, well here it is.

    Phone Them, and find out if your contract has been extended.

    If it has, then arrange a return of the goods, Before they decide it has been too long and then hold you liable for the whole contract.

    If it has not, then schedule a cancellation

    Now your choice then is simple, take a chance in the fact that they won't bother wondering where that pesky phone got too and never look into their records, I think they can do so up to 3 years following delivery, and keep it.
    Or
    Bring their attention to the fact a mistake has been made and arrange a return. You could even galvanise your neck, and stick that brass bad boy out and either go for the "I paid a portion for this phone, can ensure it gets refunded when I return it?" or even if there would be an honesty reward?
    The first one is most likely, as I believe when you were first refunded the manager most likely refunded it out of the agents leakage for the month.

    But the most resounding fact here, is you should try your earnest to get the phone returned to them
  • The order was cancelled on 16th October in writing before the phone was delivered. They are therefore fully aware that they have to cancel delivery or arrange collection. That complies with DSR regs.
    Further to that, 3 were also given notice on the 31st October that they had until 9th November to arrange collection. By then they will have had 3 weeks to arrange collection.
    On the 18th they said they would look into the matter and be in touch with 7 days!
    From what I read they haven't been in contact since then.
