    True.

However you can't lose at least the statutory part of your annual leave due to illness. If you are unable to take it for this reason you must be allowed to carry it over.
Quite. Also if it was down to the employer not allowing leave then they should have been paid for the holiday time instead at the end of each holiday year.
  • No, that's not right any more. Since April 2009 employers have not been permitted to pay in lieu of holidays not taken; they now have a responsibility to ensure that everyone takes their statutory leave. They'd be breaking the law by doing this. The only time payment can be made in lieu is when an employee leaves and is owed accrued holiday.
Cash not ash from January 2nd 2011: £2565.:j

OU student: A103 , A215 , A316 all done. Currently A230 all leading to an English Literature degree.

Any advice given is as an individual, not as a representative of my firm.

There you go! I've been self employed since 2009 so missed all the changes!
  • Looking back at things, my brother first had depression back in 2009 and he went to his GP. The GP gave him some stress tablets and told him to go home and rest. When he told his GP that sometimes he wanted to commit suicide, the GP told him not to say that as he may be locked up in the mental hospital. My brother got scared and did not ever mention his intentions of commiting suicide although he had frequent occasions of doing so. The GP did not follow up with him and my brother stopped taking the medication. The GP did not ask about it again. Since last year, my brother started to act in wierd ways and I all along thought it was stress. It was only months ago that I have realised that actually he has severe mental illness and his illness should have been treated since 2009 but the GP did not follow through. I am not here to blame anyone but I just want my brother to recover.
I thought by forcing him to resign, he will be able to relax and start recovering. But I am wrong. He is now worried about financial - how is he going to support himself? His boss has told others that my brother is mental and all his ex colleagues have stopped contacting him as his boss has told them that my brother could harm others. But that is not true at all. My brother feels he has no friends anymore.
My brother knows a lot about the wrong doings by his boss and that could have made my brother's illness worse than before.
So to get out of all this, I forced my brother to resign. When he signed the resignation note, he was crying. I felt for him but I thought by doing this, it would help him.
His boss now says my brother did this and my brother did that. They keep saying they will report to the police. I have not told my brother about this before it triggers him further.
Is there a full cure for mental illness? His doctor has told him it could take few years to see some improvements in his case. This is very worrying.

Repeating yourself over and over isn't really going to help! To be honest this is far too serious for you to be seeking the answers you want from a bunch of strangers on an internet forum who are most likely not qualified in the subject (me included).
  • Hi Lovinituk, I know what you are saying. But I am sorry. It's just I really dont know what else I can do.

I realise that but posting the same thing over and over again on this forum isn't going to help you or your brother. You need to seek professional assistance.

I think you were wrong to do this,i know you were trying to act on his behalf, your brother did say no!! But you forced him. When a persons says no,it means NO its there decision not anyone else's to intervene.

I wish your brother well and i wish you well too. Just concentrate on your brother's mental heath issues at this moment, his old job can wait.

    Totally agree.

You have to take care of your own mental state here as your obvious distress over this matter could transfer to your brother and make him worse and slow down his recovery from depression

Perhaps a case of less intervention on the OP's part.

I can totally understand what has happened here. Drastic steps have to be taken. When I read "forced to resign" I thought that is terrible, but now I see that sometimes people do drastic things for relatives. If you see a relative drowning you are only to willing to jump in and save him. However, do not be afraid to let your brother get the best treatment even if that means going into a mental hospital. I can speak from experience from having a relative having to go into a mental hospital.
