Well your options are to either wait or not to wait.
You can open a dispute, but you have 45 days to do it, so unless you think it won't come and need the money to buy another, then personally I would wait.
Ultimately you are protected by Paypal.0 -

Okay then still early days, but this depends on the initial communication you had from them.
I would email them and tell them that as they have said the item is damaged (don't mention the possible re-sale) and they have still not refunded. Then when the estimated delivery time has expired you will open a dispute and escalate straightway. Just nicely remind them that they contacted you to inform you of the damaged item and good communication between seller and buyer goes a long way.
If you hear nothing back or no goods after the 10 days then open & escalate the dispute in PayPal. You don't need to get into a verbal conflict with them just keep it light and then let the system do it's bit. Then at the point of dispute quote the message you had from them (I always communicate via eBay messages, not direct email so the message shows on my account).
Don't let one seller put you off but do check the DSR and make a judgement of their selling from what you read (also look at the *'s as well as the comments, these can say more than the written comments)Everything has its beauty but not everyone sees it.0 -
I don't think people have read the whole thread, you bought a faulty item 3 days ago. Paid and are awaiting the item. Correct?
Your getting worried because the seller relisted the item-basically as far as i would be concerned the seller has possibly 2 of the same faulty item and selling them with the same listing as they are being lazy.
What the seller is selling is really not of concern to you right now unless of course your item doesn't turn up.
It is a bit off if they haven't responded to your concerns but right now i wouldn't be looking for a refund.0 -

I think we have all read the OP's initial question and understood it! and advised accordingly. Don't forget in the initial question there was no information about how long ago the purchase was.
Since the initial contact to say the item is broken then they have heard nothing, as yet they do not know if the seller has more than one & is sending a replacement (which has slowed delivery) or is pulling a scam.
The OP has the option to wait (as replies have said) until estimated delivery has passed, contact eBay for advise or try to open a dispute (but will be told to wait as it is too soon). No, you misread this bit.
The item was sold as broken. The seller hasn't broken it since the sale.
The OP is worried that a second identical item is also being sold as broken, broken even the same way as the first.
