Recieved a Ticket from a PPC (CMS UK) and need to know what to do in MY circumsatnces

    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    Well it would seem this is true. After sending clear evidence - there is just a standard letter. This is just a game of chance they play to rake in the money - just a numbers game - tickets issued will give so much revenue? I would have thought the POPLA appeals would have been a game changer for the PPC's or are they just confident in the POPLA outcome being in their favour?

    To be honest ,i dont think the PPCs give it much thought at all. All they want is your money.
    They are not interested in anything else.

    Did the rejection template letter include a POPLA verification code? May as well use it!

    It is indeed being used:)
    For everthing else there's mastercard.
    For clampers there's Barclaycard.
  • The POPLA appeal has now been sent - However If I would have done what I thought was right it would have been wrong - The advise on here has been opposite to what I would have done.

    I have been under the assumption I was dealing with a genuine company with a genuine appeals process - not so.

    What did you put on the POPLA appeal?

    1. Display of Blue Badge not required on private land as per Blue Badge handbook, hence no loss to landowner as a result of non-display.

    2. Charge sought does not adequately reflect landowner losses and is a de facto penalty which is unenforceable under civil law relating to contracts. Dunlop v New Motor Garage.

    3. PPC has not demonstrated sufficient proprietary interest (ownership/occupation) of the land to demonstrate that they can make an offer to form a contract for services with the driver, as per VCS v HMRC.

    Somthing like that?

    I admit you made life easy for the parking company by volunteering all the information when you could have waited to let them pay for keeper details and start the chase from a blind spot: they never knew the ticket was on your windscreen when you returned, and your communications with them could have been drafted in a way that you never admitted the incident, never nominated a driver and never denied anything either. The scenario begins with a private enterprise attempting to extract an unlawful figure out of you - to that end it is not even necessary whether the contravention actually took place because nothing could warrant their demand.

    Rememebr that POPLA's outcome is not binding for you. Only the court's word must be observed, and nobody is going there. A POPLA vote of confidence to the PPC does not help their case when they seek a figure that exceeds losses.

    I must admit that thought had crossed my mind But I have had my fears squished by others here. My missus on the other hand has needed a little more convincing.:cool:

    Thanks though and worth noting as others fall foul of the PPC's - Its funny but the more I talk to people about this the more people come out of the woodwork with their story - some have had feelings of been scammed from the start, when I confirm it - they are livid but powerless to recover losses
