Why don't you try to find out if the phone is stolen or missing? If that is the case then you should be able to get in touch with the original seller and tell them this. If they don't give you your money back then report them to the police for selling stolen goods. I'm sure this is a hassle they'd rather do without and they'll probably give you your money back.

Apparently you can check if an iPhone is SIM locked by looking in
Settings => General => About => Carrier
If it's empty, it's unlocked.
Not true, if its empty, it doesn't have a signal.
It's more likely locked, easiest way to tell, put your sim in and connect to iTunes, a message will appear for locked phones.====0
