Clamping signs removed

  • Looking at the members list they have the same web site but are not ticked on any section. Still worth a punt.
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.
  • Obviously if I permanently defaced a sign with a Sharpie it would be seen as criminal damage, but what if a sticker was placed on top of the wheel clamp and the tow truck logos?

Such a sticker would be removeable, non-permanent etc etc so presumably couldn't be classed as criminal damage (a bit like how paste-up graffiti stuff isnt versus actually painting on a wall which is).......
  • Mail sent, won't hold my breath. Pity you can't use DVLA but as they have your machine its too late, that's assuming they are still clamping. I'm not waiting for 3 hours to find out, my wife or daughter could probably find something to do in a S.C. for that amount of time, but not me.

How can you cause criminal damage to an "illegal" sign?

  • Well said signs do not just state clamping and towing, they state all the other usual stuff and as far as I am aware from info on here do not need changing until sometime in the near future.

KFC in Plymouth still has clamping signs, but from what I can see no mention of any PPC, just KFC sign saying car may be clamped.

Easily it's still someone elses property and whilst they may not be allowed to display said sign as they have ,they are still allowed to possess it. As such they are entitled to be protected by the law from having their legally held property from being damaged.

Thank you for your letter received (25/10/2012) which refers to a parking incident which you experienced with (PCM South). We have given your case the reference (PCM South ) and would ask that you use this on any future correspondence. I can confirm that (PCM South) is NOT a Member of the Approved Operator Scheme which was developed to bring a degree of regulation to an industry without primary legislation. Therefore it is with regret that we are unable to actively assist you in this matter. If you wish to take it further you are advised to exhaust the operator's appeal process and if you are not satisfied with the outcome you may wish to pursue the matter through the courts. While non-Members operate under no legislation as parking on private land is unregulated, there is a clear expectation that our Members operate in a professional manner and those who are responsible for parking enforcement on private land sign up to our Code of Practice. We receive a number of complaints about our Members and all of them are investigated. If following an investigation, a member is found to be non-compliant of the Code, they would be subject to our Sanctions Scheme. Under this scheme Operators who are not compliant with the Code can expect to receive a number of penalty points depending on the severity of the offence. As with driving offences, once an operator's 'licence' has reached twelve points in any given 12-month period, then they are likely to be faced with suspension or expulsion. The Code of practice can be reviewed on our website- www.britishparking.co.uk. Many thanks for bringing this matter to my attention and may I wish you all the best with your case.
    Yours sincerely

PCM(south)shares the same website as PCM, so is the same company. If not why is it right beside the listing for PCM on the members list?

I don't know, it makes NO SENSE that they can share a website - does the website say 'they' are AOS members which would be wholly misleading?

One for the DVLA complaint list!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD
  • Could you check my facts for me, the website is just a "pay here" site.
