    Yes you can and any refund will probably be taken against outstanding debts. Your account will still be open if you still get statements but you can claim on closed accounts too. Start the process and send off for your full details of charges on the account under the Data Protection Act enclosing £10 statutory fee if applicable. Some bankes dont charge this fee and HSBC statements can be viewed online if that applies to you. Good luck :)

    interesting question - im unable to log in today, altough it was fine last night.i have just changed name and address with them so thought it may have been to do with this .or the fact that i am 100 pound over my limit due to charges! i am however making minimum repayments so assume they cant cancel my account and pass to a debt collector?.. also they only have till tommorrow before i start mcol could it be this?

    Hi,

    I am new to this forum (I have previously viewed as an outsider), and I am particularly interested in reclaiming my bank charges.

    I have numerous debts - bank accounts (one of which is failed direct debit charges) and credit cards (charges for missed payments, going over the limit etc). A lot of these accounts are closed and are now in the hands of debt recovery agents.

    I have an 'account' with CCCS, who are helping me sort myself out, I have 2 queries though.
    1) Can I reclaim charges if the debts are in the hands of debt recovery?
    2) As I have a debt management plan, can I reclaim the charges (would CCCS 'frown' upon it?

    Any advice you can give me would be great, as money that gets refunded IS going to pay more of my debts off!!!!

    Thanks in anticipation for any advice/help you can provide me.

    Have a read of the previous posts including a response from CCCS to Martin regarding reclaiming bank charges. This is not a problem to them although it is expected that any monies refunded will be put towards any debts.

    Hey guys,

    Just thought i would Update Ya'll with my case thats above , Basically I wrote a letter rather than jst sign the form they sent stating I would accept their offer on the condition that they pay me via cheque, or that the £290 be paid to account and remainder be sent to me by cheque. I promptly got letter back saying that money would only be paid into account, non-negotiable. After much thought decided i didnt really have leg to stand on if went to court as they were offering full payment, so reluctantly I signed form, faxed it back and put original in post to them (just in case) rang the following day and was told they would need to wait till original recieved before they actioned and returned money to account. Few days later I was pleasantly surprised to recieve cheque in the post for full amount (which had been signed on day of faxing) :T . Havent yet checked account to see if a payment has gone in there (you never know lol) but just wanted to let you guys know there is hope for all of us, so good luck to one and all to who ever is in the midst of battle.

  • I'm with the cccs and they have been great from the beginning, but won't give me any advice regarding reclaiming bank charges.
    So i'm unsure if i can claim anything back. I still owe Abbey £1200 and i think the charges are quite a bit more than that, would they just take the money and wipe out my debt to them?. Or does'nt it work like that?
    I've been with the cccs for nearly 2 years and my account was frozen back then so the way i see it that's 2 years of bank charges that i won't be able to claim for.
    So my question is can i still claim the charges back?

    Any help would be most appreciated.

    HI MA1GREEN, I spoke to the CCCS only last week, and they advised me to go ahead and claim charges back from RBS. They did tell me that any refund awarded would come off the amount i owed them. I am happy about this, it will reduce my debts quicker. Also my account with RBS was closed last August. Sorry, but i am not sure if you can still claim for 6 years from when your account was originally frozen. PAULA.

    can anyone help me, i have made arangements with my credit card companies to freeze the intesest, i am now wondering wether or not i am able to claim back my charges that i have incurred over the last 6 years. i dont want this to affect the arrangement that i have.
    just wonderning wether anyone else been in the same situation

    Hi All,

    I got into a bit of money trouble about 3 years ago, I managed to sort my self out. I came into some money and spread it amongst all my debts and managed to persuade them to accept the figure (about 60% of what i owed) as the full and final settlement. All my creditors accepted and then I was debt free, but most of the figure they asked for was charges.

    So can they now come back with the defense of saying, "we have already let you off £###, So this figure is in place of the charges you are now reclaiming ?

    Freezing interest is entirely voluntarily on behalf of the credit card company (or in your case: companies). Interest can be reinstated at any time. You are playing with fire.

    Is your outstanding balance higher than a potential refund? How much is the interest saved per month?
