My husband is with CCCS too, and asked them about claiming back, they said go right ahead and to do it, we are even claiming when he was with the CCCS as they were still charging him then, we will use it to pay off the debt, which is basically the charges...ironic.....Reclaimed thanks to this site: £2596.71

I am too with a debt collection agency (through default) and have been for over 6 years, am I still able to reclaim charges that were added to the account before it went to the collection. I don't want to contact the collection agency as they are difficult at the best of times.
Any help would be appreciated.

I am just wondering should you follow the same procedure on a closed account as you would a open one?.
I am not even sure if I would be able to claim charges. I had an account with HSBC but got into some problems and in the end they closed my account and passed on what I owed(a loan) to a collection agency, I have been paying them to clear the debt but obviously I no longer have an account with HSBC.
I sent the letter template asking for copies of my charges(which I suspect would be getting on for over 2 grand) but I have not had any reply yet. although my wife did get 6yrs copies of her statements even though the template letters were sent at the same time(she still banks with them).

it looks like (i think) it has no effect. b/card paid partial payment of £48 into my b/card account which is closed and with my dmp and although i have written to them to say im only accepting it as partial payment it is still in there and CCCS havent said a word to me about it (would they even notce an additional payment been made into the account?)
another bank have settled in full but paid the money into an account of my choice so i will store that away until the other bank pay up, add it together and present a full and final settlement to cccs soon i hope. mind you not sure that the 3 banks i ve claimed against w ill be impressed with me claiming back the charges then using my winnings to pay thhem off but im cracking o n with it anyway.0 -
Have now sent emails to the debt collection agencies asking for any advice, will write to them officially in the next few days, not sure what I will achieve but here goes anyway. If this pays off, I should be debt free. Fingers crossed.......0

Is your outstanding balance higher than a potential refund? How much is the interest saved per month?
I have settle all the accounts they are all closed with letter stating the fact. they all show on my credit report as being settled.
the amount I am to claim back on my Barclays Bank suprisingly (with interest) is the within a £100 pound of the amount they wrote off as part of my negotiations. but which coincidently is not much less than what I paid, taking the interest they put onto the account in the first place, I belive I wouldnt have owed them a penny if it wasnt for the unfair charges !
Would be an interesting case if it got to court. its about £2.5k
but im wondering if the fact they have already settled for less than the amount owed, whether this would effect the legal side of the argument or just annoy barclays a bit.Fluid Innovation Ltd0 -

Currently on DMP with cccs and about to start claim for unfair bank charges.
Having read all of the posts, it appears that any refund would come off the total ammount owed to bank, what gets me is that for whatever reason for me being in debt the charges applied were unfair to start with, hence everyone now applying for them back. Why should'nt people get a cheque refund for these "unfair charges" as they should'nt have been applied in the first instance. I would still be in debt to the bank wether the charges had been applied or not, basically I am claiming for something that they should'nt have been doing in the first place, regardless of one being in debt to them or not.
Obviously any refund is a bonus and will help in reducing my debt, just think that I/cccs shold be able to use it to repay all creditors pro rata.0 -

I'm currently in a Debt Management Plan with Payplan.
I have two creditors which have both agreed to my DMP.
I have somewhere in the region of £1000 in late payment charges.
Has anyone ever tried to claim back these charges whilst in a DMP?
I'm worried that if I have a go at claiming them back I might upset the apple cart and ruin my DMP.
Any advice would be greatly apprieciated.

Yes you can reclaim charges whilst in a DMP. Assuming the bank/credit card you are reclaiming charges from is one or both of your creditors the refund would be offset against your debt with them and can only help matters. Good luck0
