You can claim from a closed account but as you are with PayPlan I've merged your post with this thread so you can read up on other user's experiences.0

Re my previous post, I found the number (sorry!) I was given another number to ring (Debitas Legal Services) who said he could give me the amount of charges over the phone, I said that would be great but obviously I'd like them in writing as well, he said he would just post out the statements then. After asking for some indication of the amount he said there had been 66 charges applied to the account!! Which pays off my balance three times over! I asked for the timescale though and he said it would be 28 days:(0

I've popped you into this thread as other users have been with CCCS so their posts should help. I don't know what the situation is now you have finished this in 2003 though but... be aware these companies may expect to recoup some of the debt.0

Sorry if this has already been posted.
I'm on a Debt Management Plan with the CCCs and asked them if it's okay to reclaim my charges and I got the response below.
So guess what I'm doing this weekend, gonna get cracking on requesting a list of charges!!
Horrah!! :-)

Dear Marianne Marlow, this is the answer to your question - Thanks for the e-mail. Trying to get a refund on your charges should not make a different to your re-payment agreement. The CCCS will continue to send funds to your creditors in order to reduce the overall amount. Many thanks, Andy Richardson.

Hi Can I ask whether it's okay to claim back my bank charges while on a debt management plan with the CCCS? I would of course use the funds to pay off which ever creditor the charge comes from and reduce my debts. Thank you0 -
Advice Please.
Am looking into reclaiming charges incurred with MBNA Credit Card (At least £325 plus interest).
Defaulted on card and debt is now with debt collection agency and have debt management scheme running to repay.
If I try to reclaim charges from MBNA could they get shirty and tell debt collector to demand full repayment immediately?
Charges would not cover credit debt!0 -
I sent a DMP letter to Abbey (£1500 OD we were struggling with), then about 3 weeks later I sent the 1st letter to claim charges back.
Abbey passed us straight to a debt collector, who has been good so far, and has just said they have been authorised to offer a 50% reduction on the debt!
I have just sent the DCA a letter offering 40%... see what happens!
Not sure about MBNA as haven't had dealings with them, but the Debt Collector Abbey went through is called 'EquiDebt Ltd'I Hate Jobsworths!!!0 -
stephenc, it shouldn't have an impact on your debt management plan, I'm in the process of claiming from capital 1, Monument & gus home shopping who are in my dmp with payplan. The only thing is that I wouldn't expect mbna to send you a cheque, I'd expect them to take it off your CC debt...0

Thanks Bev79.
Would make a "small" dent in repayments.
Maybe worth it.
Am after LloydsTSB for over £5000 - waiting for first reply / standard letter.0 -
bumping so that people see it. can it be a sticky...please??
CCCS Response to me was "Trying to get a refund on your charges should not make a different to your re-payment agreement. "0 -
Hi there
I was wondering if i can still claim bank charges if im under an IVA . As i was with bank of scotland who have taken thousands of pounds in charges from me over the last couple of years. The thing is they are included in my IVA so am i still able to claim these back . the truth is the bank was the main reason for me going into the IVA due to the amount of bank charges they took from me in one month (about 1000 POUNDS in one month )i was never able to recover from this and ended up getting more charges which led to the IVA.
Is there anyone in a similiar situation or can tell me if i should try to claim and get these charges refunded. As the charges amount to over 4000 pounds in a couple of years.
Please could anybody advise me what i should do.if anything.
Thanks0
